CONTROLLED SUBSTANCE; SCHEDULES S.B. 716 (S-1):
SUMMARY OF BILL
REPORTED FROM COMMITTEE
Senate Bill 716 (Substitute S-1 as reported)
Committee: Health Policy
CONTENT
The bill would amend the Public Health Code to decrease, from 91 days to 60 days, the amount of time granted to the Board of Pharmacy (Board) to determine the schedule of a substance after that substance was designated, rescheduled, or deleted as a controlled substance under Federal law.
BRIEF RATIONALE
Drugs are scheduled within five categories based on their accepted medical use and potential for abuse and dependence, and the bill would ensure that new medications and treatments are available in a timely manner. According to testimony, most states schedule drugs immediately or within 30 or 60 days, after which patients can use those new treatments; however, the current waiting period in Michigan is 91 days. Testimony further indicates that after discussions with the Department of Licensing and Regulatory Affairs and other stakeholders, it was determined that reducing the waiting period to 60 days would be feasible and beneficial for Michiganders hoping to avail of new medications and treatments.
