A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

(MCL 750.1 to 750.568) by adding section 40a.

the people of the state of michigan enact:

Sec. 40a. The publication or sale within this state of any circular, pamphlet, or book containing recipes or prescriptions in indecent or obscene language intended to produce abortion is prohibited. For each copy of a circular, pamphlet, or other book containing such prohibited recipes or prescriptions, the publisher and seller are each guilty of a misdemeanor.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.

Enacting section 2. This amendatory act does not take effect unless Senate Joint Resolution ____ or House Joint Resolution C (request no. 03057'23) of the 102nd Legislature becomes a part of the state constitution of 1963 as provided in section 1 of article XII of the state constitution of 1963.
