CONTENT
The bill would amend Section 2 of Public Act (PA) 57 of 1988, which allows multiple municipalities to incorporate emergency services authorities, to do the following:
-- Allow incorporating municipalities to determine the territory under an authority's jurisdiction.
-- Require an incorporating municipality to post an authority's articles of incorporation to its website or, if a website were not available, in the appropriate clerk's office.
("Incorporating municipality" means a municipality that becomes part of a new authority.)
Generally, PA 57 of 1988 prescribes the process by which two or more municipalities may create an authority to provide emergency services to those municipalities. Section 2 allows incorporating municipalities to create an authority that provides emergency services by adopting articles of incorporation in the legislative body of each incorporating municipality.
Currently, an authority's jurisdiction must be comprised of the total territory within the incorporating municipalities. Instead, under the bill, an authority's jurisdiction would have to be comprised of territory within the incorporating municipalities as determined by the incorporating municipalities.
In addition, currently, the articles of incorporation of an emergency services authority must be published at least once in a newspaper designated in the articles of incorporation and circulating within the territory of the authority. Instead, under the bill, the articles of incorporation would have to be published on the website of each incorporating municipality, or, if a website were unavailable, in the clerk's office of each incorporating municipality.
