HOUSE BILL NO. 5927
An act to regulate political activity; to regulate certain actions by public officials; to prohibit certain conducts by public officials; and to provide remedies.
the people of the state of michigan enact:
(a) "Anything of value" means trips, travel, or lodging.
(b) "Immediate family member" means any of the following:
(i) A spouse of a public official.
(ii) An unemancipated individual younger than 18 years of age residing in a public official's residence.
(iii) An individual claimed by a public official as a dependent for tax purposes.
(c) "Lobbyist" means that term as defined in section 5 of 1978 PA 472, MCL 4.415.
(d) "Lobbyist agent" means that term as defined in section 5 of 1978 PA 472, MCL 4.415.
(e) "Person" means an individual, business, enterprise, franchise, nonprofit organization, proprietorship, firm, partnership, joint venture, syndicate, business trust, labor organization, company, corporation, association, committee, or any other organization or group of 2 or more persons acting jointly, regardless of legal form.
(f) "Public official" means a member of the house of representatives or senate of this state.
Sec. 3. A public official shall not do any of the following:
(a) Solicit anything of value from any person for that public official or his or her immediate family member, or another public official.
(b) Allow his or her name to be used to solicit anything of value from any person.
(c) Accept reimbursement for anything of value from any person.
Sec. 5. A public official or his or her immediate family member shall not directly or indirectly solicit, agree to accept, or accept anything of value from a lobbyist or lobbyist agent.
Sec. 7. A public official who violates section 3 or a public official and his or her immediate family member who violates section 5 shall reimburse the full amount received to the person, lobbyist, or lobbyist agent that provided anything of value to the public official or his or her immediate family member.
