A bill to amend 1994 PA 451, entitled

"Natural resources and environmental protection act,"

(MCL 324.101 to 324.90106) by adding section 5521a.

the people of the state of michigan enact:

Sec. 5521a. (1) Notwithstanding any provision of law to the contrary, the department or another state department may not adopt, enforce, or implement a state or regional program, rule, policy, or memorandum of understanding that regulates greenhouse gas emissions for the purpose of addressing changes in atmospheric temperature without specific legislative authorization, including, but not limited to, any of the following:

(a) A state plan developed pursuant to 42 USC 7402, 7410, 7411, 7415, or 7545.

(b) Low carbon fuel standards.

(c) A plan or program that enables the regulation of mobile or stationary sources, greenhouse gas taxes or fees, or greenhouse trading.

(d) A state or regional program that is prompted by the participation of the United States in an international treaty, executive agreement, or interstate compact or agreement.

(2) As used in this section, "greenhouse gas" means carbon dioxide, methane, nitrous oxide, sulfur hexafluoride, hydrofluorocarbon, or perfluorocarbon.
