I am pleased to announce the appointment of Daniel Oberlin as Assistant Secretary of the Senate.

Mr. Oberlin has a rich history in the Senate where he previously worked for Senator Burton Leland and Senator Mark Schauer, and most recently was the director of the Senate Democratic Policy Office. He is an alumnus of Michigan State University where he was a Richard B. Gerisch Scholar and graduated with honors in 2003.

We are happy to have Mr. Oberlin join our team. His 16 years of legislative experience will continue to benefit the Michigan Senate.

Department of Labor and Economic Opportunity

February 14, 2020

The unemployment agency shall make an annual report to the legislature on the operation of the program. The first report under this subsection is due within 60 days after the first anniversary date of the beginning of the program. Each report under this subsection must include, but is not limited to, the following for the previous 12-month period:

a)  Number and type of claimants served.

b)  Number and type of employers served.

c)  Costs to the program of the claimants served.

d)  Costs to the program of the employers served.

e)  An analysis of the impact of the services provided on the appeal system provided by this act.

 

February 20, 2020

The Work Share Program was created by the enactment of Public Act 1 of 1936, Section 421.28b to 421.28m of the Michigan Employment Security (MES) Act. The purpose of Work Share is to allow an employer to maintain operational productivity by reducing the work hours of employees during an economic decline in regular business activity instead of laying-off employees. With the plan, eligible employees work a reduced number of hours in the work week and receive a portion of weekly unemployment benefits.

Per Section 421.28l of the MES Act, the Unemployment Insurance Agency (UIA) shall submit to the Governor, the Secretary of the Senate, and the Clerk of the House of Representatives for referral to the Chair and Minority Vice-Chair of the appropriate committees an annual report regarding shared-work plans under sections 28b to 28m. The report shall include the number of approved shared-work plans, the number of participating employers, the number of participating employees, the amount of compensation and aid to participating employees, and any other information the UIA determines is relevant to assess the impact of shared-work plans on the unemployment compensation fund. The first report shall be submitted on or before the first day of March following the first complete calendar year during which sections 28b to 28m are in effect, and subsequent reports shall be submitted on or before the first day of March of each subsequent year.

February 27, 2020

In accordance with Section 8 of the Michigan Employment Security Act, being Section 421.8 of the Michigan Compiled Laws, the Department of Labor and Economic Opportunity, Unemployment Insurance Agency is required to report annually to the Governor and the Legislature any amount, in excess of $1.00, that the maximum weekly unemployment benefit rate would increase if the annual increase in the United States Department of Labor’s Consumer Price Index (CPI) were applied to the maximum weekly benefit rate for Michigan.

I am, therefore, transmitting to the Governor, and to the House and Senate for publication along with this letter in the Journals of their respective bodies, the enclosed report showing that since the last increase in the maximum weekly benefit rate to $362.00 in 2002, the increase in the CPI would result in an increase in the maximum weekly unemployment benefit rate to $501.15.

Amendment of Executive Order 2019-14

 

UP Energy Task Force

 

Department of Environment, Great Lakes, and Energy

 

On June 7, 2019, Executive Order 2019-14 established the UP Energy Task Force (“Task Force”).

Section 2(b) of Executive Order 2019-14 charged the Task Force with preparing a final report and submitting it to the governor in two stages, with the first submission – a propane plan focused on alternative means to supply propane to the Upper Peninsula (“UP”) – due March 31, 2020.

In carrying out this charge, the Task Force has continually sought and benefited from input provided by residents of this state. The work of the Task Force would benefit from an extension of the deadline for submitting its propane plan, to permit more time for public comment.  

Section 1 of article 5 of the Michigan Constitution of 1963 vests the executive power of the State of Michigan in the governor.

Acting under the Michigan Constitution of 1963 and Michigan law, I order that Section 2(b) of Executive Order 2019-14 be amended to read as follows:

The Task Force shall prepare a final report and submit it to the governor. The Task Force shall complete its final report in two stages. First, the Task Force shall submit a propane plan to the governor by April 17, 2020. This plan shall focus on alternative means to supply propane to the UP, consistent with section 2(a) of this order. Second, the Task Force shall submit the remainder of its report, also consistent with section 2(a), by March 31, 2021.

This order is effective upon filing.

Senator Hertel’s statement is as follows:

Today I rise and ask for your support for my legislation to create a tax check-off for the Michigan chapter of the Pediatric Congenital Heart Association.

Congenital heart disease is the No. 1 birth defect and consists of problems with the heart’s structure or the way it works that are present at birth, including related life-long consequences. One in 100 newborns are born with CHD, there is an estimated two to three million people living with CHD, and 25 percent of children born with CHD need heart surgery or other intervention to survive.

On October 23, 2015, Ruby Jane Schupbach, the inspiration for this legislation, was born with CHD. Ruby, the fourth child to David and Gail Schupbach, at one month old, had her first open heart surgery. She is now four and has had three open-heart surgeries and more than ten heart catheterizations. Ruby is more than just a statistic, and will have a long road ahead for her CHD journey; but like many CHD warriors, you wouldn’t know it when you meet her. She is happy, playful, and precocious.

While there is no cure, thanks to advances in medical research, more and more children are surviving. Over 85 percent of babies born with CHD will now live to reach the age of 18. Michigan families have found their support in the Pediatric Congenital Heart Association. They have been connected to research, resources, and comfort. All funds raised through this check-off will go to the Michigan chapter of the Pediatric Congenital Heart Association in support of their efforts to improve the lives of those with CHD and their families through direct support, education, research, and awareness.

Please join me in supporting the millions of individuals living with congenital heart disease by voting in support of this legislation.

Most of you know that I have a small child—he’s four-and-a-half years old. I haven’t had the pleasure of taking and posting the first-day picture, but I think many of us would love to have—through you, Madam Secretary—that you require that your Assistant Secretary take the first day of school picture with me and anybody else who wants to take it. As most of you know, he’s been a staffer for us for a long time. He’s a very reserved person, so I probably am already embarrassing him more than he would like.

I think you did a great job of describing his background—and I’m joking here because it’s emotional when you lose somebody, although we didn’t lose you very far—I was fine with you moving up there. I was actually very thrilled to make the recommendation. You’ve been a tremendous staffer and you’re an amazing person, Dan. You’re a great father. You’re a great husband. You’ve done an amazing amount of work for our caucus and the state. I think anybody who’s worked with you would say you’re fair, you’re knowledgeable, and you’re respectful. I think you are the epitome of what a staffer should look like. In case you don’t want to, I’m going to ask that your new boss make you take a picture with me and I’ll post the first day picture. You’re not my son, of course, but you’re a tremendous person and it would be a pleasure to do it.

A bill to amend 1956 PA 62, entitled “An act to authorize the director of the department of state police to promulgate a uniform traffic code; to authorize a city, township, or village to adopt the uniform traffic code by reference without publication in full; and to prescribe criminal penalties and civil sanctions for violation of the code,” by amending section 1 (MCL 257.951), as amended by 2006 PA 297.

With the recommendation that the bill pass.

The committee further recommends that the bill be given immediate effect.
