A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 5113 (MCL 333.5113), as amended by 1988 PA 491.
the people of the state of michigan enact:
Sec. 5113. (1) Except as
otherwise provided in part 52 and section 9123, this article and articles 6 and
9 or the rules promulgated under those articles shall not be construed to
require the any of the following:
(a) The medical treatment, testing, or examination of an individual
who objects on the grounds that the medical treatment, testing, or examination
violates the personal religious beliefs of the individual or, of if the individual
is a minor, the parent, guardian, or person in loco parentis of a the minor.
(b) The administration of an immunizing
agent to an individual due to a pandemic if any of the following apply:
(i) The individual objects on either of
the following grounds:
(A) That immunization violates the
personal religious beliefs of the individual or, if the individual is a minor,
the parent, guardian, or person in loco parentis of the minor.
(B) That the individual or, if the
individual is a minor, the parent, guardian, or person in loco parentis of the
minor, has other objection to immunization.
(ii) A physician certifies that the immunizing
agent is or may be detrimental to the individual's health or is not
appropriate.
(2) This section does not exempt an individual from compliance with applicable laws, rules, or regulations regarding sanitation and the reporting of diseases as provided by this code.
