A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 20210.
the people of the state of michigan enact:
Sec. 20210. (1) The department shall
establish and maintain a database of nursing homes and homes for the aged as a
central clearinghouse for persons seeking information on a nursing home or a home
for the aged. Subject to subsection (2), the database must include, at a
minimum, all of the following:
(a)
The name, address, and telephone number of each nursing home or home for the
aged.
(b)
The days and general hours of operation of each nursing home or home for the
aged.
(c)
The license number, license effective date, and license expiration date of each
nursing home or home for the aged.
(d)
A rating for each nursing home or home for the aged based on standards defined
by the department that must include the number and nature of complaint
investigations regarding each nursing home or home for the aged. For the rating
described in this subdivision, the department shall assign a letter grade of A,
B, C, D, or F.
(e)
A list of each violation of this article or a rule promulgated under this
article by a nursing home or home for the aged.
(f)
The number and nature of disciplinary actions taken by the department against
each nursing home or home for the aged under this article.
(g)
The number, nature, and results of complaint investigations regarding each nursing
home or home for the aged conducted by the department.
(h)
The number, nature, and results of abuse, neglect, and exploitation
investigations conducted under sections 11 to 11e of the social welfare act,
1939 PA 280, MCL 400.11 to 400.11e, that involve a patient or resident of a nursing
home or home for the aged.
(i)
A link to the federal Medicare "Nursing Home Compare" website, which
provides inspection reports on nursing homes.
(2)
The department shall not include in the database established under subsection
(1) any information that is prohibited from being disclosed under the laws of this
state or federal law.
(3)
The department shall make the database established under subsection (1)
available to the public on the internet, without charge, through the
department's website, and the database must be developed in a manner so as to
be easily accessible and navigable by the general public.
(4)
The department shall inform the public, through press releases or other media
avenues, of the information available in the database established under
subsection (1) and how to access that database.
