CONTENT
The bill would amend Part 115 (Solid Waste Management) of the Natural Resources and Environmental Protection Act to delay the sunset on the solid waste surcharge collected by the Department of Environment, Great Lakes, and Energy (EGLE) from October 1, 2019, to October 1, 2023. Fees are paid by solid waste facilities (primarily landfills) based on the number of cubic yards of waste deposited at the facility. The fee currently is 12 cents per cubic yard. Revenue from solid waste surcharge fees is credited to the Solid Waste Management Fund. The Solid Waste Management Fund supports administration of the construction permit and operating license program for solid waste handling or disposal facilities.

FISCAL IMPACT
The bill would have a positive fiscal impact on EGLE and no fiscal impact on local units of government. The bill would prevent EGLE from losing approximately $6.0 million in fee revenue each year. Revenue from the fee is credited to the Solid Waste Management Fund and is used to offset the costs related to permit review and other costs incurred by EGLE for administration of the solid waste construction permit and operating license program.
The fiscal year 2019-20 EGLE budget as approved in Senate Bill 137 (S-2) CR-1 assumes EGLE will be able to collect these fees at their current levels.
