REVISE DEFINITION OF MICRO BREWER

House Bill 5400 as introduced

Sponsor:  Rep. Alex Garza

Committee:  Regulatory Reform

Complete to 2-3-20

SUMMARY:

House Bill 5400 would amend the Michigan Liquor Control Code to revise a reference contained in the definition of “micro brewer” to refer to section 203a of the code instead of section 203. The bill is part of a larger package of bills to revise provisions concerning such things as tax payment frequency, brand extensions, beer festival special licenses, and beer in growlers, among others.

[A provision regarding the sale and delivery of beer to a retailer by a micro brewer or an out-of-state entity that is the substantial equivalent of a micro brewer would be removed from section 203 by HB 5342 and placed in a new section 203a by HB 5343.]

The bill is tie-barred to HBs 5341 to 5355. A bill cannot become law unless each of the bills to which it is tie-barred is also enacted.

MCL 436.1109

FISCAL IMPACT:

House Bill 5400 would not have a fiscal impact on any unit of state or local government.
