SUMMARY:
House Bill 5176 would amend 1921 PA 2, which governs certain powers and duties of the State Administrative Board, to provide an exception to the board’s power to inter-transfer funds within an appropriation for a particular department or institution.
1921 PA 2 creates the State Administrative Board and enumerates several of its powers and duties. Under the act, the board does not have the power to transfer to a state department, board, commission, officer, or institution any sum from the amount appropriated by the legislature for any other purpose, except that the board may inter-transfer funds within the appropriation for a particular department, board, commission, officer, or institution.
The bill would retain the exception allowing the board to inter-transfer funds within an appropriation for a particular department or institution, but would stipulate that the board could exercise this power only “unless otherwise provided by law.”
