OF ITEM OF APPROPRIATION

House Bill 5175 as introduced

Sponsor:  Rep. Ben Frederick

Committee:  Government Operations

SUMMARY:

House Bill 5175 would amend 1921 PA 2, which governs certain powers and duties of the State Administrative Board, to provide an exception to the board’s power to inter-transfer funds within an appropriation for a particular department or institution.

1921 PA 2 creates the State Administrative Board and enumerates several of its powers and duties. Under the act, the board does not have the power to transfer to a state department, board, commission, officer, or institution any sum from the amount appropriated by the legislature for any other purpose, except that the board may inter-transfer funds within the appropriation for a particular department, board, commission, officer, or institution.

Under the bill, the State Administrative Board would need approval by the House and Senate Appropriations Committees to make an inter-transfer of appropriations for a particular department or institution if the inter-transfer would do either of the following:

·         Increase or decrease an item of appropriation by more than 3% or $125,000, whichever is greater.

·         Increase or decrease an item of appropriation by more than $200,000 in the aggregate.

FISCAL IMPACT:

House Bill 5175 would have no fiscal impact on state or local government.
