An act to amend 1939 PA 280, entitled “An act to protect the welfare of the people of this state; to provide general assistance, hospitalization, infirmary and medical care to poor or unfortunate persons; to provide for compliance by this state with the social security act; to provide protection, welfare and services to aged persons, dependent children, the blind, and the permanently and totally disabled; to administer programs and services for the prevention and treatment of delinquency, dependency and neglect of children; to create a state department of social services; to prescribe the powers and duties of the department; to provide for the interstate and intercounty transfer of dependents; to create county and district departments of social services; to create within certain county departments, bureaus of social aid and certain divisions and offices thereunder; to prescribe the powers and duties of the departments, bureaus and officers; to provide for appeals in certain cases; to prescribe the powers and duties of the state department with respect to county and district departments; to prescribe certain duties of certain other state departments, officers, and agencies; to make an appropriation; to prescribe penalties for the violation of the provisions of this act; and to repeal certain parts of this act on specific dates,” (MCL 400.1 to 400.119b) by adding section 111n.

An act to amend 1998 PA 386, entitled “An act to codify, revise, consolidate, and classify aspects of the law relating to wills and intestacy, relating to the administration and distribution of estates of certain individuals, relating to trusts, and relating to the affairs of certain individuals under legal incapacity; to provide for the powers and procedures of the court that has jurisdiction over these matters; to provide for the validity and effect of certain transfers, contracts, and deposits that relate to death; to provide procedures to facilitate enforcement of certain trusts; and to repeal acts and parts of acts,” by amending section 5306 (MCL 700.5306), as amended by 2004 PA 532.

Subsequent to the final adjournment of the Regular Session of the Legislature, the following message from the Governor was received:

December 20, 2019

Today I signed SB 348, which provides that when the Department of Health and Human Services issues a new interpretation of Medicaid provider policy that directly affects nursing facility Medicaid costs reports, the change in policy must have a prospective effective date.

I am giving this bill my approval because I agree that when the department reinterprets Medicaid provider policy—usually by issuing a Policy Bulletin (e.g. MSA 19-28)—that change should apply prospectively in order to give providers adequate notice of the change. Nevertheless, this bill does not affect the department’s application of a current interpretation of policy to a new factual scenario. It also does not restrict the department’s ability to apply its current interpretation of policy to audits of prior fiscal years, so long as the current interpretation of policy was in effect during the relevant audit period.
