Today I vetoed Enrolled House Bill 5634. The bill would have amended the Michigan Vehicle Code to allow, among other things, greater use of tinting on vehicle windows. Specifically, the bill would have revised or deleted existing provisions of law concerning the application of window tint on a motor vehicle’s windshield, rear window, or side window to the rear of the driver.

The bill would have increased the potential risk of harm to law enforcement personnel, particularly when approaching a vehicle during traffic enforcement stops by making it more difficult for law enforcement personnel to view a vehicle’s interior and contents, including the number and location of occupants inside the vehicle.

With that in mind, I have vetoed Enrolled House Bill 5634.

Today I am returning to you unsigned House Bill 6499. The bill would have amended the Michigan Zoning Enabling Act to increase the allowable number of children who can receive care at particular state licensed residential facilities.

While the proposed amendments to the zoning statute do not directly impact the Children’s Services Administration or the Division of Child Welfare Licensing within DHHS, they do directly impact Child Caring Institutions (CCI) who are licensed by the Division of Child Welfare Licensing. Current Michigan law caps CCI foster youth occupancy at six residents or less. The bill would allow for 10 foster youth residents or less at a CCI facility located on a parcel of 20 acres or more.

As the number of foster youths have increased across the state, expanding the capacity for CCI facilities that can place foster youths is crucial. However, the critical needs of fostered youth must be balanced with the ability to effectively provide them with the precious care that they deserve. While seemingly well intended, increasing the capacity and concentration of fostered youths could negatively impact the goals of providing foster youth care.

I do not believe that this legislation was as thoroughly evaluated before final passage, and therefore, I am returning HB 6499 to you today without my approval.

Today I vetoed House Bill 5143 and House Bill 5680. Both bills would have amended the General Property Tax Act in regard to the exemption of alternative energy personal property. Specifically, Enrolled House Bill 5143 would have eliminated the existing certification and exemption-approval process for alternative energy personal property that is conducted by the Michigan Next Energy Authority and local units.

Unfortunately, the bill presented several technical issues that it failed to resolve. For example, the bill would have afforded differential treatment of alternative energy personal property installed before the bill’s effective date versus such property installed after that date. Furthermore, the bill would have imposed an $80,000 true cash value limit for such property installed after the bill’s effective date, but was ambiguous concerning the relevant governmental jurisdiction within which the $80,000 limit would have applied.

Enrolled House Bill 5680 was more straightforward and acceptable. It essentially would have added the installation of alternative energy personal property to the definition of normal maintenance, which now includes replacing or repairing such property. However, House Bill 5680 is tie-barred to House Bill 5143. Because I have vetoed House Bill 5143, House Bill 5680 will not take effect and therefore I am also returning it to you without approval.

Today I vetoed Enrolled House Bill 5916 and Enrolled House Bill 5917. Enrolled House Bill 5916 would have amended Public Act 287 of 1969, which governs pet shops and animal control and protection shelters. The bill would have imposed a number of specific requirements upon pet shops, and owners, managers, and employees of pet shops.

Local control is a longstanding concept in Michigan and any concerns the bill might have addressed are manifestly local in nature. To the extent such concerns exist in a given local unit, local officials should be afforded the discretion to address them rather than having the State impose a one-size-fits-all approach.

Enrolled House Bill 5917 raises similar considerations. It would have created a new public act to prohibit local units from enacting or enforcing ordinances, policies, resolutions, or rules that would have arbitrarily banned qualified pet shops. Because Enrolled House Bill 5917 was tie-barred to Enrolled House Bill 5916, my veto of the latter necessitates the same result for the former.

With that in mind, I have vetoed Enrolled House Bill 5916 and Enrolled House Bill 5917.

Today I am vetoing House Bill 4081 and Senate Bill 35. Both bills amend the Traxler-McCauley-Law-Bowman Bingo Act of 1972 to provide for authorization of licensing and regulation of millionaire parties by the Michigan Gaming Control Board.

Millionaire Parties began as “Vegas Night” fundraisers at fraternal clubs and religious institutions, but over time, some morphed into unlicensed and unregulated “charity casinos” or “poker rooms.” Because these locations were not regulated, some of the people running these games engaged in unlawful conduct. In 2012, I transferred oversight of millionaire parties to the Michigan Gaming Control Board (MGCB) and directed it to bring integrity to these games while still allowing the various charity groups to raise money. Despite obstacles, the MGCB accomplished its mission. Many violators were prosecuted or at least shut down. Unlicensed operators were prohibited and replaced by licensed gaming suppliers.

Charities, too, benefited from these changes. As charities began exercising more oversight of their games, the size and scope of millionaire parties grew and remains robust. Over the last four years, charities have conducted over 36,000 millionaire party events and had over $325 million in chip sales. Charities also appreciated the MGCB’s focus on customer service; a 2017 PriceWaterhouseCoopers customer service survey of charities indicated that the vast majority (87%) are satisfied with the MGCB’s millionaire party licensing services.

The bills eliminate those administrative rules that have allowed charitable gaming activities to grow and operate in a controlled environment that protects the public welfare. I am pleased that the MGCB was able to successfully resolve the problems posed by the large-scale, unregulated gambling that. MGCB’s work has brought integrity and accountability to these games while allowing charities to earn tens of millions of dollars for good causes—and did so in a customer-friendly way. This legislation, if signed, would undermine the work the MGCB has done over the past six years and return millionaire parties to a underregulated market ripe with potential for fraud and abuse. Accordingly, I am vetoing House Bill 4081 and Senate Bill 35.

Today I am returning to you unsigned House Bill 6485.

The bill would exclude certain production costs from the adjustment required by law to ensure income taxed by the state severance tax was excluded from the Income Tax. The bill would narrow the expenses required to be added back after they had been deducted at the federal level. This would result in some expenses being deducted twice at the state level.

The tax reforms I worked with our legislative partners on in 2011 sought to eliminate tax deductions or loopholes that resulted in unfair benefit for some taxpayers. This bill would run contrary to that objective.

I appreciate the fact that over the eight years in which I was governor, my Administration worked closely with our legislative partners to craft sound public policy. However, I do not believe that this particular legislation reflects the priorities I have worked towards, and therefore, I am returning House Bill 6485 to you today without my approval.

Today I am returning to you unsigned House Bill 6420.

The bill would have created a new act, the Fantasy Contests Consumer Protection Act, to establish a statutory framework to regulate fantasy contests within the state, to place oversight of fantasy contests within the Michigan Gaming Control Board, and to create civil, administrative, and criminal penalties for violations of the act.

The bill was presented as part of a larger package of bills intended to modernize the way consumers could engage in gaming in Michigan. While I am sympathetic with the idea of regulating fantasy contests in a manner consistent with recent federal law changes, I understand that there are many important factors, some of which may be unknown at this time, to evaluate before proceeding with a substantial regulatory structure that has such a significant potential impact to Michigan citizens.

While well intended, I do not believe this legislation at this time would accomplish positive results for Michigan, therefore, I am returning HB 6420 to you today without my approval.

Ladies and Gentlemen:

Today I am returning House Bills 4926, 4927, and 4928 to you without my approval. The bills would have implemented a new regulatory system for regulating internet gambling. While I appreciate the amount of work that went into the effort to get these bills, along with several others passed in the last few weeks of the legislative session, I am vetoing these bills due to several concerns.

HB 4926 would have enacted the Lawful Internet Gaming Act to provide the regulatory structure for internet gambling conducted through websites owned and operated by Detroit’s three casinos and those operated by our federally recognized Indian tribes. HB 4927 and HB 4928 would make accompanying changes to Michigan’s criminal law.

A significant amount of work went into these bills and getting them to a place where several stakeholders either expressed support or neutrality, and I appreciate that many pro-gaming stakeholders coalesced around these bills. However, due to largely unknown budgetary concerns, I believe this legislation merits more careful study and comparison with how other states have, or will, authorize online gaming. To be blunt, we simply don’t have the data to support this change at this time.

Principally, gambling behavior could shift from the State’s iLottery program to internet-based gambling at casinos. In Fiscal Year 2017, the lottery distributed $924.1 million to the School Aid Fund. For each $10 of spending on the lottery, the School Aid Fund receives approximately $2.76. Under HB 4926, because of its lower tax rate, each $10 in online betting translates to just four cents deposited into the School Aid Fund. Such a significant reduction, without a clearer understanding of internet gambling revenue growth potential is concerning. Moreover, I am also concerned that revenues may be lost as gambling behavior shifts from on-premises, to online.

Finally, I am concerned that the bills will encourage gambling by making it much easier to do so. I do not think it is appropriate to sign legislation that will effectively result in more gambling, with a reasonable chance that the state could lose revenue that could be helpful in dealing with social service issues that are ordinarily attendant to increased gambling behavior.

As a result, I am vetoing HB 4926, HB 4927, and HB 4928 so that the legislature and next administration can more thoroughly evaluate the revenue implications from authorizing internet gambling.

Ladies and Gentlemen:

Today I am vetoing House Bill 6553, a bill to provide for automatic standing for either chamber of the legislature to intervene in certain litigation in state courts.

I appreciate the concern that the legislature believes it is uniquely positioned to defend the constitutionality of laws it defends, in particular when executive branch officials may have differing positions. I also understand some other states provide their legislatures with this automatic right, and that the United States Congress often authorizes itself to participate in litigation.

The governor, as chief executive officer of the state, is responsible for managing the litigation position of the State as an entity. This legislation, while well-intentioned to ensure that the laws duly passed by the legislature and signed by the governor are properly defended, would serve only to complicate the management of that litigation.

For example, imagine a scenario where the State of Michigan is a defendant to a lawsuit challenging the validity of a recently enacted statute. The governor, as CEO, and thus client, is responsible for coordinating the State’s response to the litigation with her or his attorneys at the Department of Attorney General. The Attorney General his- or herself could conceivably erect a conflict wall and take a position “on behalf of the people” that is different from that which the governor as CEO takes. Consider then that the House of Representatives intervenes in the lawsuit to take another position. And then the Senate similarly intervenes and takes yet another position. Who then is speaking in court for the State?

Additionally, legislators routinely seek intervention in litigation in which they are interested through the ordinary intervention process in the Michigan Court Rules. That process has seemingly worked well at ensuring legislators have a say in litigation in which they are interested. Moreover, legislators are permitted to request permission to file amicus briefs to ensure that courts are made aware of their unique perspectives on matters.

While I understand and appreciate the desire for the legislature to have automatic standing to participate in litigation, I believe the current process has worked well to ensure the legislature’s position is considered. Furthermore, were this legislation in place during my term as governor, I believe it would have limited my office’s ability to coordinate and manage the defense of the state in lawsuits. Accordingly, I do not believe it prudent to sign this legislation as my term as governor comes to an end.
