     A bill to amend 1919 PA 339, entitled

 

"Dog law of 1919,"

 

by amending section 9 (MCL 287.269), as amended by 2000 PA 438.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 9. (1) Each dog license issued under this act shall

 

display all of the following:

 

     (a) An expiration date. Subject to section 6(4), the

 

expiration date for a license issued under section 6(2) or 6(3)(b)

 

shall be expires 1 year after the date on or before which the

 

license was required to be obtained under section 6, and for a

 

license issued under section 6(3)(a) or 6(3)(c), shall be 1 year or

 

3 years after that date. Subject to section 6(4), the expiration

 

date of a license issued under section 6(3)(d), (e), or (f) shall


be is the earlier of the following:

 

     (i) One year or 3 years, as applicable, after the date on

 

which the license was required to be obtained.

 

     (ii) The expiration date of the dog's rabies vaccination.

 

     (b) A serial number corresponding to the number on the metal

 

tag furnished to the owner.

 

     (c) The name of the county issuing the license.

 

     (d) A full description of the dog licensed.

 

     (e) Upon the request of an applicant, a notation indicating

 

that the dog licensed is a service animal, emotional support

 

animal, or therapy animal, if the applicant provides all of the

 

following:

 

     (i) For a service animal, an affidavit signed by the person

 

seeking the notation in this subsection attesting that the dog for

 

which the notation is being sought has been individually trained to

 

do work or perform tasks for the benefit of an individual with a

 

disability as defined in section 12102 of the Americans with

 

disabilities act of 1990, 42 USC 12102, and 28 CFR 36.104.

 

     (ii) For a service animal, an emotional support animal, or a

 

therapy animal, a basic obedience program certificate of completion

 

issued by a basic obedience training instructor or provider under

 

section 9 of the assistance animal basic obedience training and

 

instruction act, or the equivalent as determined by the department

 

of agriculture and rural development.

 

     (2) A person who knowingly or willingly submits a false or

 

fraudulent affidavit under subsection (1)(e)(i) or a false or

 

fraudulent basic obedience program certificate of completion, or


the equivalent, under subsection (1)(e)(ii) is guilty of a

 

misdemeanor punishable by 1 or more of the following:

 

     (a) Imprisonment for not more than 93 days.

 

     (b) A fine of not more than $500.00.

 

     (c) Community service for not more than 30 days.

 

     (3) As used in this section, "service animal", "emotional

 

support animal", or "therapy animal" means those terms as defined

 

in section 2 of the assistance animal basic obedience training and

 

instruction act.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 5281 (request no.

 

04634'17) of the 99th Legislature is enacted into law.
