HOUSE BILL No. 4573

     A bill to amend 1846 RS 16, entitled

 

"Of the powers and duties of townships, the election and duties of

township officers, and the division of townships,"

 

(MCL 41.1a to 41.110c) by adding section 3b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3b. (1) A township may provide by ordinance a procedure

 

to finance by special assessments the provision of mosquito

 

abatement by private contractors. The ordinance must authorize the

 

township board to initiate the establishment of a special

 

assessment district under this section by resolution. In addition,

 

the ordinance must authorize the use of petitions to initiate the

 

establishment of a special assessment district under this section.

 

If petitions are used to initiate the establishment of a special

 

assessment district under this section, the owners of not less than

 


25% of the land to be made into the special assessment district

 

must sign the petitions to initiate the establishment of the

 

special assessment district.

 

     (2) If a township board adopts a resolution to initiate the

 

establishment of a special assessment district as provided under

 

subsection (1) or if the owners of not less than 25% of the land to

 

be made into the special assessment district sign petitions to

 

initiate the establishment of a special assessment district as

 

provided in subsection (1), then the question of raising money for

 

mosquito abatement by special assessment must be submitted by the

 

township board to those electors residing in that portion of the

 

township located in the special assessment district at a general

 

election or special election called for that purpose by the

 

township board.

 

     (3) A special assessment district for mosquito abatement is

 

established only if a majority of the electors residing in that

 

portion of the township located in the special assessment district

 

voting on the question approve the special assessment district.

 

     (4) A special assessment district for mosquito abatement

 

established under this section may be discontinued upon petition by

 

the owners of not less than 51% of the land comprising the special

 

assessment district.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
