(A) “CONSTRUCTION” MEANS THE CONSTRUCTION OF NEW SALES OR SERVICE FACILITIES BY A NEW MOTOR VEHICLE DEALER, OR THE SUBSTANTIAL REMODELING, IMPROVEMENT, RENOVATION, EXPANSION, REPLACEMENT, OR ALTERATION OF A DEALER’S EXISTING SALES OR SERVICE FACILITIES. THE TERM DOES NOT INCLUDE INSTALLATION OF SIGNS OR OTHER IMAGE ELEMENTS THAT ARE SUBJECT TO THE INTELLECTUAL PROPERTY RIGHTS OF THE MANUFACTURER, INCLUDING LOGOS, TRADEMARKS, TRADE DRESS, PATENTS, OR OTHER INTELLECTUAL PROPERTY.” and relettering the remaining subdivisions.

3. Amend page 33, line 2, after “MANUFACTURER” by striking out “TO” and inserting “OF”.

House Resolution No. 472.

A resolution to declare December 14, 2018, as Frostbitten Convention Day in the state of Michigan.

Whereas, On a bitterly cold day in 1836, the Frostbitten Convention took place in Ann Arbor, Michigan, and sought to see an end to the Toledo War, which was a dispute between the territory of Michigan and state of Ohio over rightful claim to the Toledo Strip; and

Whereas, A compromise was proposed in the summer of 1836 by President Andrew Jackson to offer the western portion of the Upper Peninsula along with statehood to the territory of Michigan. The region known as the “Toledo Strip” would be granted to the state of Ohio; and

Whereas, Under the guidance of Territorial Governor of Michigan, Stevens T. Mason, a convention known as the “Frostbitten Convention” was convened in Ann Arbor, Michigan. On December 14, 1836, convention delegates voted to accept the western region of the Upper Peninsula and paved its way to statehood; and

Whereas, On January 26, 1837, the United States Congress granted statehood to Michigan; and

Whereas, To this day, the western portion of the Upper Peninsula has led itself to have vast resources within the region. Michigan’s leadership in forestry and the mining of both copper and iron ore have grown exponentially. In this year of 2018, we recognize the 182nd anniversary of the Frostbitten Convention; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare December 14, 2018, as Frostbitten Convention Day in the state of Michigan; and be it further

Resolved, That copies of this resolution be transmitted to Marquette Regional History Center and the Peter White Public Library.

Rep. Geiss, having reserved the right to explain her protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

Today, I voted no on SB 1198, which eliminates the sunset on legislation (SB 753/ PA 359 of 2016) that banned the use of telemedicine in prescribing and administering medication abortion. I voted no, because it limits reproductive healthcare options for women. Telemedicine in general expands access to health care in every corner of our state, something women in Michigan desperately need when it comes to reproductive care, especially considering that nearly 33% of Michigan’s 83 counties do not have an OB/GYN, but all 83 counties has a veterinarian.

Telemedicine expands access to health care and allows doctors to examine, diagnose and treat patients without having to be in the same room. For people living in areas with limited access to a health home-base, access to telemedicine can be life-changing. Making it illegal for doctors to prescribe the abortion pill via telemedicine is shortsighted, inappropriate, and very likely unconstitutional. The Iowa Supreme Court ruled that bans like these placed an undue burden on a woman’s right to access abortion services.

Such medical experts as the American College of Obstetricians and Gynecologists, oppose laws like this one. There is no medical, scientific or legal argument for banning telemedicine-administered medication abortion. Making medical abortion available via telemedicine doesn’t increase the number of abortions performed – and banning it only makes it harder for women to access a safe, legal medical procedure to which they are constitutionally entitled and it is clear that this legislation is meant to be punitive for women who access abortion. It is curious that the only prescription banned by telemedicine is the medication used for medically induced abortions. At a time where the state has decided to limit who has access to earned paid sick leave and the ability to have time to go to the doctor, we should be seeking to increase access to such options as telemedicine and the services that healthcare providers can perform or prescribe via telemedicine, rather than limiting them. The bottom line is that politicians are not medical experts and have no business placing themselves between a patient and their healthcare provider.”
