“Awesome and mighty God; we come before You today to give thanks. We thank You for Your blessing and peace on our lives; we thank You for the blessings of our family and love ones. We thank You for the colleagues with whom we serve today.

Today we lift up our hearts in prayer for governments and leadership all around this world; from international to national, to state and local government, we pray this prayer seeking wisdom knowledge and understanding in decision-making.

Let us remember that true religion is to see about the widows and the orphans of society, the broken, the downtrodden and all those that do not have a voice. Second Reading of Bills

Senate Bill No. 776, entitled

A bill to amend 1954 PA 116, entitled “Michigan election law,” by amending section 472a (MCL 168.472a), as amended by 1999 PA 219.

Was read a second time, and the question being on the adoption of the proposed amendment previously recommended by the Committee on Elections (for amendment, see House Journal No. 39, p. 649),

The amendment was not adopted, a majority of the members serving not voting therefor.

Rep. Hoadley moved to amend the bill as follows:

1. Amend page 1, line 4, after “than” by striking out “180” and inserting “364”.

The motion did not prevail and the amendment was not adopted, a majority of the members serving not voting therefor.

Rep. Pagan moved to amend the bill as follows:

1. Amend page 1, following line 6, by inserting:

“Sec. 786. Only 1 voter at a time shall be permitted to pass within the guard rail to vote. The operating of the voting machine by the elector while voting shall be secret and obscure, from all other persons, except as provided by this act in cases of assisted electors or a minor child accompanying an elector in the booth or voting compartment under section 736a. A voter shall not have the right to remain within the voting machine booth longer than 2 minutes and if he or she refuses to leave it after the lapse of 2 minutes, the voter shall be removed by the inspectors. However, the inspectors may grant the voter further time in their discretion.”.

The motion did not prevail and the amendment was not adopted, a majority of the members serving not voting therefor.

Rep. Irwin moved to amend the bill as follows:

1. Amend page 1, following line 6, by inserting:

“Enacting section 1. This amendatory act does not take effect unless House Bill No. 4724 of the 98th Legislature is enacted into law.”.

Pursuant to Joint Rule 20, the full title of the act shall be inserted to read as follows:

“An act to reorganize, consolidate, and add to the election laws; to provide for election officials and prescribe their powers and duties; to prescribe the powers and duties of certain state departments, state agencies, and state and local officials and employees; to provide for the nomination and election of candidates for public office; to provide for the resignation, removal, and recall of certain public officers; to provide for the filling of vacancies in public office; to provide for and regulate primaries and elections; to provide for the purity of elections; to guard against the abuse of the elective franchise; to define violations of this act; to provide appropriations; to prescribe penalties and provide remedies; and to repeal certain acts and all other acts inconsistent with this act,”

The House agreed to the full title.

Rep. Nesbitt moved that the bill be given immediate effect.

The motion prevailed, 2/3 of the members serving voting therefor.

Rep. Lyons, having reserved the right to explain her protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

It is absolutely good policy to eliminate rebuttable presumption, and I support instituting a firm timeframe for the validity of petition signatures. I believe those who want to change the Board of State Canvassers’ decades-old policy regarding rebuttable presumption are indeed themselves attempting to change the rules in the middle of the game. However, passing this bill with immediate effect changes the rules in the middle of the game as well. As the Elections Committee debated the legislation, I offered an amendment to make the law effective January 1, 2017 because- despite the attempt of some petition circulators to change the rules in the middle of the game- I do not think it is wise for the legislative body to impact those who are currently circulating petitions and hope to have their questions on the November 2016 ballot. The amendment was adopted in committee, but unfortunately the January 1, 2017 effective date was stripped on the floor and replaced with immediate effect. Therefore, I cannot support Senate Bill 776.”

Rep. McBroom, having reserved the right to explain his protest against the passage of the bill, made the following statement:

“Mr. Speaker and members of the House:

I am disappointed to be voting no on SB 776. I believe that it is right to set a firm date on signature collection and to eliminate a never used, cumbersome methodology for prolonging the acceptable days of signature validity to up to four years. I could consider an amount of days slightly longer than 180 but am not persuaded of its necessity. One hundred eighty days has been a very successful amount of days for many years in Michigan. Now groups that repeatedly find it difficult to gather the necessary signatures within that time period are looking to change the rules- without even trying the existing process to utilize lapsed signatures. It is right to prevent this from happening so that Michigan does not descend into the chaos loose, direct democracy often creates. Access to the ballot for statute or constitutional amendment or referendum is purposefully designed to be difficult to protect the republican form of government our state follows by order of our own constitution and the US Constitution.

All that said, I must oppose the bill because of the removal of the grandfathering provision. It is inherently unfair to change the rules of the game in the midst of it. The several petitions now being circulated rightly deserve to complete their efforts with all statutes in place that were present at the beginning of their efforts. This would include their ability to petition the board of canvasers for a policy change as they have done and been denied. They should then be allowed to pursue rebutting the staleness of the signatures by the existing policy.

Even the most wholesome food can be rendered inedible by the smallest drop of poison. The removal of the phase-out language is more than a drop of poison and therefore I must refuse to accept the whole.”

An act to amend 1949 PA 300, entitled “An act to provide for the registration, titling, sale, transfer, and regulation of certain vehicles operated upon the public highways of this state or any other place open to the general public or generally accessible to motor vehicles and distressed vehicles; to provide for the licensing of dealers; to provide for the examination, licensing, and control of operators and chauffeurs; to provide for the giving of proof of financial responsibility and security by owners and operators of vehicles; to provide for the imposition, levy, and collection of specific taxes on vehicles, and the levy and collection of sales and use taxes, license fees, and permit fees; to provide for the regulation and use of streets and highways; to create certain funds; to provide penalties and sanctions for a violation of this act; to provide for civil liability of manufacturers, the manufacturers of automated technology, upfitters, owners, and operators of vehicles and service of process on residents and nonresidents; to regulate the introduction and use of certain evidence; to provide for the levy of certain assessments; to provide for the enforcement of this act; to provide for the creation of and to prescribe the powers and duties of certain state and local agencies; to impose liability upon the state or local agencies; to provide appropriations for certain purposes; to repeal all other acts or parts of acts inconsistent with this act or contrary to this act; and to repeal certain parts of this act on a specific date,” by amending section 323 (MCL 257.323), as amended by 2001 PA 159.

Explanation of “No” Votes

Rep. McBroom, having reserved the right to explain his protest against the passage of House Bill No. 5314, made the following statement:

“Mr. Speaker and members of the House:

This bill builds on the good work done in previous sessions to address the problem of concussions with student athletes. The bulk of these programs already exists and this bill mostly changes some reporting requirements. However, the bill also includes a special dispensation requested by the universities of our state. They expressed concerns about seventeen year old college students participating in intramural sports at the various state institutions. I object to the inclussion of this language because it shows the continued duplicity of these same institutions.

These institutions continually claim State Constitution provisions; article XIII, section 4, grant them complete autonomy from all statutes. This autonomy is often cited at these institutions’ great convenience. However, today, they find it convenient to hide behind the work of the legislature instead of their own choices. I reject this attempt of the institutions to pick and choose their battles and vote against this bill for this reason.”

I did not rise for immediate effect on Senate Bill 776. The House did not demonstrate sufficient support for motions for immediate effect. Article 4, Section 27 of the Michigan Constitution requires a 2/3rds vote in favor of a motion for immediate effect. There was not 2/3rds support for the motion.

In addition, members were denied the Constitutional rights afforded under Article 4, Section 18. By continuing the practice of blatantly disregarding our Constitution and depriving the citizens of the transparency promised by Article 4, Section 18, the public is harmed. For the sake of transparency, accountability, and the rule of law, we need to follow the Constitution.

The Clerk received the following dissent from Rep. Singh:

I did not rise for immediate effect on Senate Bill 776. The House did not demonstrate sufficient support for motions for immediate effect. Article 4, Section 27 of the Michigan Constitution requires a 2/3rds vote in favor of a motion for immediate effect. There was not 2/3rds support for the motion. In addition, the chair did not state that immediate effect was granted. It is a shame that the majority blatantly disregarded the constitution in their attempt to silence the voice of Michigan citizen’s ability to petition their government.
