A bill to amend 2013 PA 240, entitled
"Michigan state capitol historic site act,"
by amending section 6 (MCL 4.1946).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 6. (1) The commission shall do all of the following:
(a) Subject to subsection (2), operate and manage the Michigan
state
capitol historic site.State
Capitol Historic Site.
(b)
Maintain, and repair,
restore, renovate, and improve the
state
capitol building.State
Capitol Building and any other
facilities within the Michigan State Capitol Historic Site.
(c) Maintain, repair, restore, renovate, and improve the
grounds
of the Michigan state capitol historic site.State Capitol
Historic Site.
(d) At its discretion, acquire and construct any new facility
within the Michigan State Capitol Historic Site.
(e) (d)
Appoint an individual to manage the
day-to-day
operations
of the Michigan state capitol historic site. State
Capitol Historic Site. The individual appointed under this
subdivision is an at-will employee and shall serve at the pleasure
of the commission.
(f) (e)
Employ staff to carry out the
commission's
responsibilities
under this subsection (1) and as otherwise
provided by law. All individuals employed by the commission are
nontenured, at-will employees. The commission may discipline,
transfer, demote, suspend, or summarily discharge an employee.
(g) (f)
Contract with any person for
purposes of procuring
goods or services or otherwise carrying out the commission's
responsibilities
with regard to the Michigan state capitol historic
site.State Capitol Historic Site.

Make recommendations to the governor,
the senate, and
the house of representatives regarding funding for the Michigan
state
capitol historic site, State
Capitol Historic Site,
including, but not limited to, funding from the fund.
(i) (h)
Carry out other responsibilities as
provided by law.
(2) The commission does not have authority and shall not
exercise control over the internal decisions of the senate or the
house of representatives related to the allocation of space in the
state
capitol building State
Capitol Building or the state
capitol
building
State Capitol Building parking lot, including legislative
or
staff offices. All decisions concerning space in the state
capitol
building State Capitol
Building and the state capitol
building
State Capitol Building parking lot shall be made according
to the rules or practices of the senate and the house of
representatives.
(3) The state administrative board at the request of the
commission may convey to the Michigan strategic fund property under
control of the commission or an interest in property under control
of the commission for the purpose of financing and constructing any
new facility within the Michigan State Capitol Historic Site.
However, the commission shall not convey the property on which the
State Capitol Building resides or the State Capitol Building
itself. The commission may enter into a lease with the financing
entity to be paid from funds appropriated to the commission. A
lease entered into under this subsection must provide for the
conveyance to this state of the leased property after the payment
of all lease obligations. In addition, the commission may enter
into an easement, right of entry, or any other agreement necessary
to allow for the construction and use of a new facility within the
Michigan State Capitol Historic Site.
(4) In connection with the financing of any new facility
within the Michigan State Capitol Historic Site under subsection
(3), the commission may agree to the financing by the Michigan
strategic fund of any other improvements related to the State
Capitol Building, including, but not limited to, mechanical,
electrical, fire suppression, sewer, and plumbing systems. The cost
of these improvements may be included as part of the financing
undertaken by the Michigan strategic fund for any new facility
within the Michigan State Capitol Historic Site and shall be repaid
by lease payments. The Michigan strategic fund may issue bonds for
the purposes of funding a new facility and any improvements to the
State Capitol Building.
(5) As used in this section, "Michigan strategic fund" means
the Michigan strategic fund as described in the Michigan strategic
fund act, 1984 PA 270, MCL 125.2001 to 125.2094.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No. ____ or House Bill No. 6048 (request no.
06699'16 *) of the 98th Legislature is enacted into law.
