SUMMARY:
House Bill 5774 amends the Adult Foster Care Facility Licensing Act (MCL 400.701–737) in the following ways:
· Require the Community and Health Systems Bureau within the Department of Regulatory Affairs to notify the clerk of a city, village, or township, and require the Fire Services Bureau in LARA to notify the local fire chief of the emergency closure of an adult foster care facility contemporaneously when the summary suspension order is served.
· Make it clear that the term "department" refers generally to the Department of Licensing and Regulatory Affairs (LARA) rather than the Department of Human Services (DHHS). The bill also updates references so as to continue to refer to DHHS where appropriate.
· Lower an outmoded population threshold that currently refers to a city with a population of not less than one million; the new threshold in the bill is not less than 600,000. This change is made to a provision that applies only to Detroit, and allows the state to contract with the city fire marshal to inspect adult foster care facilities.
The bill takes effect April 9, 2017.
