SUMMARY:

Under the bills, the Secretary of State is required to develop and then implement, in conjunction with the Department of State Police, implement a process using the LEIN (Law Enforcement Information Network), or any other appropriate system that limits access to law enforcement, that will allow law enforcement agencies in Michigan access to emergency contact information voluntarily provided to the Secretary of State by the holder of a driver license or an official state personal identification card.  This must be accomplished no later than January 1, 2017.

House Bill 4459 amends the Michigan Vehicle Code (MCL 257.310) to apply to driver licenses.   House Bill 4460 amends Public Act 22 of 1972 (MCL 28.292) to apply to official state personal identification cards.

The bills define the term "emergency contact information" to mean the name, telephone number, or address of an individual used for the sole purpose of contacting that individual when the licensee has been involved in an emergency.

The bills also make a technical amendment regarding information that may appear in electronic or machine readable codes on digitized licenses and identification cards needed to conduct a transaction with the Secretary of State.   

FISCAL IMPACT:  

The bills would have an indeterminate fiscal impact to the state. The Department of State would face an increased cost to update departmental software for the emergency contact information. The department has typically spread out similar technology costs over several fiscal years. However, if current funding levels cannot accommodate the increased technology cost to meet the deadline imposed by the bill, the department could need supplemental appropriations to cover the increase.  There would be no fiscal impact to local governments.
