Motions and Resolutions

Reps. Darany, Driskell, Heise, Hoadley, Hughes, Kelly, Leutheuser, Maturen, Moss, Sarah Roberts and Singh offered the following resolution:

House Resolution No. 54.

A resolution to commemorate the 150th anniversary of the end of the American Civil War.

Whereas, The American Civil War started on April 12, 1861, and came to an end on April 9, 1865, when General Robert E. Lee surrendered to General Ulysses S. Grant at Appomattox Virginia. The conflict began when Confederate forces fired upon Fort Sumter off the coast of South Carolina and the surrender of the fort three days later sparked the deadliest war in American history, resulting in the deaths of an estimated 750,000 soldiers.; and

Whereas, Prior to the surrender of Fort Sumter, seven states had already declared their secession from the Union and established a new federal government - the Confederate States of America. Newly-elected President Abraham Lincoln called for every state to provide troops in the war effort and shortly thereafter, four more states joined the Confederacy; and

Whereas, As members of the United States House and Senate resigned their seats in Congress, many legislative initiatives that had been blocked by Southern legislators before the war were quickly passed. These laws included: the Morrill Act, which created our nation’s land grant colleges; the Homestead Act, opening up expansion in the West; a number of Transcontinental Railroad Acts; the National Banking Act; and the Revenue Act of 1861 to help finance the war efforts; and

Whereas, On July 2, 1862, the War Department assigned Michigan a quota of 11,686 as part of the proclamation for 500,000 men. Michigan originally sent one regiment of infantry, fully armed, clothed, and equipped to aid the federal government. Although the state was not in a condition to meet this request, subscription made the necessary amount available and ten companies were at once mobilized; and

Whereas, The First Michigan Infantry Regiment was heavily engaged at the First Battle of Bull Run on July 21, 1861, near Manassas, Virginia. The battle was a resounding defeat for the Union, but the First acquitted itself well. Of the 500 men who went into action that day, 117 were casualties, including the regiment’s commander, Colonel Willcox, who was wounded and taken prisoner. By December 1861, Michigan had sent 13 infantry regiments, three cavalry regiments, and five batteries of light artillery totaling 16,475 officers and enlisted men to the front; and

Whereas, From April 1861 to April 1865, Michigan furnished 90,747 men, not counting others who served in the units of other states. According to official regimental commander’s reports, Michigan soldiers engaged the enemy on more than 800 occasions. Of the officers serving, 177 were killed, 85 died of wounds, and 96 died of disease. Among the enlisted men, 2,643 were killed, 1,302 died of wounds, and 10,040 died of disease. Many Michigan soldiers finished their three-year enlistment period at the beginning of 1864 and 5,545 veterans reenlisted. Units that had reenlisted soldiers were able to display a “Veteran” designation on their battle flags which proved formidable on the battlefield; and

Whereas, During the war, Michigan furnished more than 30 regiments of infantry including the 1st Michigan Colored Infantry formed on February 17, 1863. From the first major engagements to the end of the war, Michigan soldiers played an integral part in the conflict. They were present when General Robert E. Lee surrendered to General Ulysses S. Grant at Appomattox and were present in the capture of Confederate President Jefferson Davis at the close of the Civil War by Michigan’s Colonel Benjamin Pritchard and the 4th Michigan Cavalry; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body commemorate the 150th anniversary of the end of the American Civil War. We commend all those who fought and those who continue to make sure that their sacrifices are never forgotten.

House Resolution No. 55.

A resolution to declare April 2015 as Student Athlete Cardiac Awareness Month in the state of Michigan.

Whereas, The state of Michigan has lost at least 63 students to sudden cardiac arrest and related causes since December 1999; and

Whereas, Those students lost include: 15-year-old Kimberly Anne Gillary, a student of Troy Athens High School who suffered a sudden cardiac arrest in a high school water polo game at Birmingham Groves High School on April 1, 2000; Kayla Stanford, a student at Ypsilanti East Middle School, who suffered a cardiac arrest after completing track practice on March 29, 2006; Thomas Noah Smith, a student of Flushing High School, who suffered a sudden cardiac arrest on January 29, 2011; and Wes Leonard, a student at Fennville High school who suffered a sudden cardiac arrest after scoring the winning basket in a basketball game on March 4, 2011, and

Whereas, The families of Kimberly Anne Gillary, Kayla Stanford, Thomas Noah Smith and Wes Leonard have established Foundations (the “Foundations”) in the memory of their lost sons and daughters to try to prevent other families from losing their sons and daughters to sudden cardiac arrest at school, and

Whereas, The Foundations have donated more than 800 Automated External Defibrillators (AEDs) to high schools and intermediate schools in the State of Michigan and have provided training to teachers and staff on the use of an AED and in CPR, and

Whereas, Approximately 75% of all Michigan high schools now have at least one AED on site due to the efforts of the Foundations founded by the families, and

Whereas, There have been at least 11 lives saved at Michigan high schools as a result of AEDs donated by the Foundations and other concerned organizations including 9 students, and

Whereas, As a result of the efforts of the Foundations, the Michigan Department of Community Health (MDCH), and the Michigan High School Athletic Association (MHSAA) there is an increased awareness of the importance of more effective pre-participation screening of our high school student athletes and of having readily available AEDs in our high schools, and

Whereas, The Foundations have worked with the Michigan Department of Community Health to develop the Michigan HeartSafe School Program to encourage Michigan high schools to receive certification as a Michigan HeartSafe School, and

Whereas, The Michigan Legislature has passed legislation to amend MCL 29.19 to require the governing body of any school in Michigan that operates any of grades kindergarten to 12 to adopt and implement a Cardiac Emergency Response Plan for the school, and

Whereas, Governor Snyder signed legislation to amend MCL 29.19 on February 25, 2014, thereby establishing that it is the public policy of the State of Michigan that Michigan schools be adequately prepared to respond to a cardiac emergency on school property; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare April 2015 as Student Athlete Cardiac Awareness Month in the state of Michigan; and be it further

Resolved, That the people of the state of Michigan are encouraged to become more aware of the importance of improved pre-participation screening of our student athletes and the preparedness of our citizenry and public employees to respond to the sudden cardiac arrest of our sons and daughters while entrusted to our public schools in the course of their education; and be it further

Resolved, That the State Board of Education be urged to include provisions in policies and regulations for AED training in student health education courses and for regular AED drills, so that students and staff will be better prepared to use AEDs to save lives in schools and other public places; and be it further

Resolved, That the State Board of Education advise schools to facilitate the education of students and their families to identify situations where students may be at risk; and be it further

Resolved, That copies of this resolution be transmitted to The Kimberly Anne Gillary Foundation, The KAYLA Foundation, The Thomas Smith Memorial Foundation, The Wes Leonard Heart Team and the State Board of Education as a symbol of our support.

House Resolution No. 56.

A resolution to declare April 18-25, 2015, as Money Smart Week in the state of Michigan.

Whereas, The Federal Reserve Bank of Chicago coordinates Money Smart Week, a nationwide annual public awareness and educational campaign that takes place April 18-25, 2015; and

Whereas, Money Smart Week is a designed to help consumers better manage their personal finances through educational programming offered to all demographics and income levels and covers all facets of personal finance; and

Whereas, Michigan has participated in Money Smart Week for many years through the through the collaboration and coordinated effort of hundreds of organizations including financial institutions, non-profit groups, government entities, schools, and libraries; and

Whereas, The week showcases these organizations’ educational resources, strengthens private-public partnerships, engages the media, and connects people with those who can help them learn how to better manage their money; and

Whereas, Personal financial education and money management skills are crucial to enable Michigan residents to manage credit and debt and be responsible workers, heads of households, homeowners, investors, entrepreneurs, business leaders, and productive citizens; and

Whereas, Over 250,000 participants nationwide benefitted from Money Smart Week last year nationwide with Michigan among the states with a large involvement. Last year in Michigan 455 events were conducted during Money Smart Week by 245 partners in 47 counties reaching 13,051 participants of all ages with money management education; and

Whereas, Money Smart Week highlights the commitment of credit unions throughout the state to strengthen the financial knowledge and capability of people through financial education; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare April 18-25, 2015, as Money Smart Week in the state of Michigan. We acknowledge the great contributions of Money Smart Week in our state; and be it further

Resolved, That we call on each resident, business, community organization and unit of government to observe this week with participation in Money Smart Week programs and activities.

A bill to amend 1951 PA 51, entitled “An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to promote safe and efficient travel for motor vehicle drivers, bicyclists, pedestrians, and other legal users of roads, streets, and highways; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, local bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts,” by amending section 10p (MCL 247.660p), as added by 2010 PA 135.

A bill to amend 1941 PA 122, entitled “An act to establish the revenue collection duties of the department of treasury; to prescribe its powers and duties as the revenue collection agency of this state; to prescribe certain powers and duties of the state treasurer; to establish the collection duties of certain other state departments for money or accounts owed to this state; to regulate the importation, stamping, and disposition of certain tobacco products; to provide for the transfer of powers and duties now vested in certain other state boards, commissions, departments, and offices; to prescribe certain duties of and require certain reports from the department of treasury; to provide procedures for the payment, administration, audit, assessment, levy of interests or penalties on, and appeals of taxes and tax liability; to prescribe its powers and duties if an agreement to act as agent for a city to administer, collect, and enforce the city income tax act on behalf of a city is entered into with any city; to provide an appropriation; to abolish the state board of tax administration; to prescribe penalties and provide remedies; and to declare the effect of this act,” by amending section 30 (MCL 205.30), as amended by 2014 PA 424.
