     A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

(MCL 257.1 to 257.923) by adding section 823.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 823. (1) By February 1 of each year, a local or county

 

law enforcement agency that uses a registration plate reading

 

device shall provide a report to the department of state police

 

that contains all of the following information regarding the use of

 

registration plate reading devices by the agency for the preceding

 

calendar year:

 

     (a) The number of registration plates read each month.

 

     (b) The number of vehicles reported stolen or missing that

 

were recovered through the use of the devices.

 


     (c) How long the agency retains information from the devices.

 

     (d) How the agency disposes of information from the devices.

 

     (e) Any other information required to be reported by the

 

department of state police.

 

     (2) After receiving the reports under subsection (1), the

 

department of state police shall compile the information received

 

with the same information regarding the use of registration plate

 

reading devices by the department of state police for the preceding

 

calendar year. The department of state police shall prepare a

 

report to the governor and the standing committees of the house of

 

representatives and the senate with jurisdiction over

 

transportation and law enforcement matters that contains the

 

information compiled under this subsection.

 

     (3) The department of state police shall annually reimburse a

 

local or county law enforcement agency for the cost of compiling

 

and providing information as required by this section.

 

     (4) As used in this section, "registration plate reading

 

device" means a device that uses automated high-speed camera and

 

optical character recognition technology to passively read motor

 

vehicle registration plate information, that immediately compares

 

that information against other information contained within or

 

accessible to the device, that sends an audible or visual alert if

 

data are determined by the device to be relevant, and that stores

 

registration plate information that has been read for a prescribed

 

period of time.
