A bill to amend 1899 PA 44, entitled
"An act to provide for the publication and distribution of
publications, laws, and documents, reports of the several
officers, boards of officers and public institutions of this
state now or hereafter to be published; to provide for the
replacing of publications lost by fire or otherwise; to provide
for the publication and distribution of the Michigan manual; to
provide for duties of certain state and local government
departments and agencies; to establish certain funds; and to
provide for certain penalties and remedies,"
by amending sections 1, 2, 24, 25, 30, and 32 (MCL 24.1, 24.2,
24.24, 24.25, 24.30, and 24.32), sections 1 and 30 as amended by
1995 PA 179, section 2 as amended by 2004 PA 15, and sections 24,
25, and 32 as amended by 1988 PA 185; and to repeal acts and
parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. (1) The legislative service bureau, under the
1 direction of the legislative council, shall, as soon as
2 practicable after the close of any session of the legislature,
3 carefully examine, classify, assign compilation numbers to, and
4 catchline , and index the acts passed and prepare them for
5 publication by the legislative service bureau. The publication
6 shall include the following:
7 (a) A title, preface, and table of contents.
8 (a) (b) All
acts of a general character which that affect
9 the people of the whole state.
10 (b) (c) All
joint resolutions.
11 (c) (d) All
amendments to the state constitution of 1963
12 adopted after the publication of the acts of the last preceding
13 session of the legislature.
14 (d) (e) All
acts of a local or municipal character which
15 that do not affect the people of the whole state.
16 (e) (f) All
initiated laws.
17 (f) (g) All
veto messages of the governor.
18 (g) (h) All
executive orders by which the governor makes
19 changes in the organization of the executive branch or in the
20 assignment of functions among its the executive branch's units
21 which that require the force of law.
22 (h) (i) Abstracts
of proceedings of boards of supervisors
23 organizing new townships, consolidating townships, or changing
24 the boundaries of townships, received and filed in the office of
25 the secretary of state after the publication of the acts of the
26 previous session of the legislature.
27 (i) (j) Abstracts
of proceedings relative to incorporation
1 and change of boundaries of cities and villages filed in the
2 office of the secretary of state after the publication of the
3 acts of the previous session of the legislature.
4 (j) (k) Abstracts
of proceedings relative to the
5 incorporation of charter townships filed in the office of the
6 secretary of state after the publication of the acts of the
7 previous session of the legislature.
8 (k) (l) A certificate of the secretary of state setting
forth
9 the date of the final adjournment of the legislative session at
10 which the acts published were enacted, and setting forth in the
11 same certificate the date upon which all such those acts,
not
12 given immediate effect or carrying an effective date, shall take
13 effect according to the state constitution of 1963.
14 (l) (m) That part of the annual report of the state
treasurer
15 for the latest completed fiscal year as shall give that gives an
16 accurate account of the receipts and expenditures of public
17 money.
18 (m) (n) The
Michigan compiled laws table.
19 (o) An index.
20 (2) The legislative service bureau, under the direction of
21 the legislative council, shall include each final adopted
22 apportionment and districting plan with the public and local acts
23 of the first regular session following the date on which the plan
24 becomes law.
25 (3) The items described in subsections (1) and (2) shall be
26 published with the following title text:
1 "PUBLIC AND LOCAL ACTS
2 MICHIGAN
3 SESSION OF....."
4 (YEAR)
5 (4) The public and local acts shall be sequentially arranged
6 by act number, with boldfaced compilation numbers and catchlines
7 of a style similar to compilation numbers and catchlines in the
8 Michigan Compiled Laws. The senate or house of representatives
9 bill number of each public or local act shall appear in
10 parentheses in boldfaced type immediately below the act number.
11 In cases where a section appearing in the last preceding
12 compilation of the general laws has been amended, the catchline
13 of that section shall contain the compilation number given to
14 that section in the compilation and that number shall be in
15 boldfaced type. The corresponding citation to the Michigan
16 statutes annotated shall be placed in brackets in boldface
17 immediately following and as part of the catchline to each
18 section. Cardinal numerals shall be printed in figures and not
19 written out, except when a sentence begins with a cardinal
20 numeral.
21 (2) (5) As
used in this section, "publication" or
22 "published" means the production and dissemination of information
23 in print, microfilm, microfiche, or electronic form.
24 Sec. 2. (1) The legislative service bureau, at the direction
25 of the legislative council, shall publish at least 1 print copy
26 of the publication containing the public and local acts of each
27 session of the legislature. The legislative service bureau shall
1 also make the publication containing the public and local acts of
2 each session of the legislature available on the internet.
3 (2) There may be published The legislative service bureau
4 may publish additional copies of the public and local acts as the
5 legislative service bureau, upon the direction of the legislative
6 council, considers necessary. Unless otherwise directed by the
7 legislative service bureau, these copies shall be deposited with
8 the department of management and budget for sale and future
9 distribution.state
library.
10 (3) The legislative service bureau may prepare, at not less
11 than the actual cost, reprints of laws upon particular subjects
12 for printing and distribution. The department of treasury shall
13 publish and distribute all pamphlets of the general tax law or of
14 all other laws relating to the revenues of the state.
15 (4) As used in this section, "publication" or "published"
16 "publish" means the production and dissemination of information
17 in print, microfilm, microfiche, or electronic form.
18 Sec. 24. (1) The legislative service bureau, under the
19 direction of the legislative council, shall prepare and publish
20 biennially an official state manual to be known as the "Michigan
21 Manual", to be distributed by the department of management and
22 budget to the persons and
officers named in this act, which shall
23 be ready for distribution before December 2 of each odd-numbered
24 year.
25 (2) The secretary of state shall provide the legislative
26 service bureau with voting results and statistics adequate for
27 the bureau to provide the voting information required by section
1 25.
2 (3) The secretary of state shall deliver the voter
3 information required by subsection (2) in time to allow the
4 legislative service bureau to meet the publication date in
5 subsection (1).
6 Sec. 25. The Michigan manual shall contain the following:
7 (a) The constitution of the state of Michigan and a list of
8 amendments proposed, adopted, and rejected; the method of
9 proposal and the vote thereon; the vote by which the state
10 constitution was adopted; and the vote on constitutional
11 revision.
12 (b) A list of post offices in Michigan.
13 (c) A list of newspapers in Michigan.
14 (d) The latest statistics of educational, mental, medical,
15 reformatory, and penal institutions of the state, arranged in
16 such a way as to show the cost of conducting each of those
17 institutions during the immediately preceding 2 fiscal years;
18 salary of officers; the amount of legislative appropriations;
19 receipts from all other sources; all expenditures and for what
20 purposes; and showing the number of students, patients, or
21 convicts, according to the nature of each institution, and the
22 instruction or employment given in each.
23 (e) A table of valuation of taxable property in the counties
24 of the state as fixed by the state board of equalization for each
25 of the latest 2 years.
26 (b) (f) The
names, ages, occupations, residences, politics,
27 and prior legislative service of the members of both houses of
1 the legislature, and the names and residences of their officers.
2 (c) (g) The
names and residences of state officers and
3 members of state boards and state institutions.
4 (d) (h) A
list of standing committees of both houses of the
5 legislature.
6 (e) (i) Representation
by counties of members of both houses
7 of the legislature.
8 (f) (j) A
list of former officials of the United States from
9 Michigan.this state.
10 (g) (k) A
list of former state officials of Michigan this
11 state showing their county of residence.
12 (h) (l) The names of officers and delegates to the
13 constitutional conventions of Michigan.this state.
14 (i) (m) The
judicial systems of Michigan.this
state.
15 (n) The state judiciary.
16 (j) (o) The
territory and population of judicial circuits.
17 (p) The names and dates of public holidays.
18 (q) The report of the state treasurer.
19 (k) (r) Statistics
of the public school system of
20 Michigan.this state.
21 (s) A list of names and addresses of intermediate school
22 districts in Michigan, showing the counties where they are
23 located.
24 (l) (t) Statistics of former legislatures of Michigan, this
25 state, giving length of session, number of laws enacted, number
26 of joint resolutions, total membership, and politics.
27 (u) Names of members of former Michigan legislatures sitting
1 within the latest 10 years, giving post-office addresses at time
2 of membership, districts, and terms.
3 (m) (v) Names
of speakers and speakers pro tem of all former
4 houses of representatives, with districts from which chosen, and
5 counties of residence, and terms of service.
6 (n) (w) Names
of all former clerks of the house of
7 representatives, with post-office addresses at time chosen and
8 terms of service.
9 (o) (x) Names
of presidents pro tem of the senate of all
10 former legislatures of Michigan, this state, with districts
from
11 which chosen, counties of residence, and terms of service.
12 (p) (y) Names
of all former secretaries of the senate, with
13 post-office addresses at time chosen and terms of service.
14 (q) (z) Names
of former Michigan members of the
United
15 States senate from this state with dates of election and years of
16 service arranged to show a history of occupancy of each of the 2
17 seats.
18 (r) (aa) Names
of former Michigan members of the United
19 States house of representatives from this state, with dates of
20 election and years of service.
21 (bb) Lists of miscellaneous state associations, officers,
22 and their residences.
23 (s) (cc) Congressional,
senatorial, and representative
24 districts, with the territory and population thereof.of those
25 districts.
26 (dd) A list of county officers elected at the preceding
27 November election.
1 (t) (ee) The
official canvass of votes cast at the preceding
2 primary election for governor, lieutenant governor, United States
3 senator, members of congress, and members of the legislature.
4 (u) (ff) The
official canvass of votes cast at the preceding
5 November election for electors of president and vice president of
6 the United States, state officers, members of the legislature,
7 United States senator, members of congress, and of proposals
8 submitted to the people.
9 (v) (gg) A
summary of votes cast at the preceding November
10 election for state officers.
11 (w) (hh) A
summary of votes cast for all governors of
12 Michigan.this state.
13 (ii) The official canvass of votes cast at the April
14 election in the biennium for which the manual is issued, for
15 state officers, justices of the supreme court, and circuit
16 judges.
17 (x) (jj) A
descriptive summary of the duties of the several
18 departments of the state government.
19 (y) (kk) A
descriptive outline of the organization of the
20 military department.
21 (ll) A
complete list of all departments, boards, commissions,
22 and agencies of the state government, including special
23 commissions created by executive authority and all ex officio
24 boards, setting forth by reference the authority for their
25 creation, whether constitutional, statutory, executive order, or
26 other authority.
27 (z) (mm) Biographical
sketches of present United States
1 senators from Michigan, this
state, members of national the
2
United States house of representatives
from Michigan, this state,
3 members of the state legislature, and elective state officers.
4 (aa) The United States constitution, including amendments,
5 unless otherwise specifically directed by the legislative
6 council.
7 (bb) (nn) Any
other matter considered essential by the
8 legislative service bureau if adequate funding is available.
9 Sec. 30. (1) The legislative service bureau shall publish
10 sufficient copies of the "Michigan Manual", to be distributed
as
11 provided in subsection (2) and as directed by the legislative
12 council.
13 (2) The department of management and budget shall deliver
14 the following number of copies to the following persons:
15 (a) Members of the senate, 1.
16 (b) Members of the house, 1.
17 (2) (3) The
legislative service bureau shall determine a
18 price per publication copy not to exceed the cost of preparation
19 and distribution and , unless directed otherwise by the
20 legislative service bureau, the department of management and
21 budget shall sell the
copies of the publication not distributed
22 pursuant to subsection (2).(1).
23 (3) (4) The
Michigan manual fund is created in the state
24 treasury and shall be administered by the legislative council.
25 Any money received from the sale of the Michigan manual shall be
26 deposited with the state treasurer to the credit of the Michigan
27 manual fund and shall be used to pay the costs of preparing and
1 distributing the Michigan manual.
2 (4) (5) As
used in this section, "publication" or
3 "published" "publish"
means the production and dissemination
of
4 information in print, microfilm, microfiche, or electronic form.
5 (6) The legislative service bureau, under section 25(nn),
6 shall include in the Michigan manual the United States
7 constitution, including amendments, unless otherwise specifically
8 directed by the legislative council.
9 Sec. 32. The county superintendents of schools shall
10 distribute all copies of the "Michigan Manual" to the schools
in
11 their respective counties, as provided in section 30 of this act
12 and insure that the copies are kept for the use of such schools.
13 The secretary of state shall direct and oversee the prompt
14 distribution of the documents and reports mentioned in this act,
15 distribution of which is not otherwise provided for; and such
16 those documents and reports shall be shipped to the several
17 county clerks and county superintendents of schools in the state,
18 and be distributed by them to the persons within their respective
19 counties entitled to the same, and until so distributed, they
20 shall be carefully preserved by the county clerks and county
21 superintendents of schools.
22 Enacting section 1. Sections 5 and 37 of 1899 PA 44, MCL
23 24.5 and 24.37, are repealed.
