SENATE BILL No. 1128

     A bill to amend 1953 PA 232, entitled

 

"Corrections code of 1953,"

 

(MCL 791.201 to 791.285) by adding section 37a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 37a. (1) Except as otherwise provided in this subsection,

 

before a prisoner is released on parole or discharged upon

 

completion of his or her maximum sentence from a correctional

 

facility, the department shall take or cause to be taken a test

 

specimen of the prisoner and shall submit the specimen to a

 

clinical laboratory for the purpose of performing a test for the

 

hepatitis C virus. The department is not required to comply with

 

this subsection if the prisoner has already been diagnosed as

 

having the hepatitis C virus.

 

     (2) For a prisoner who is scheduled to be released on parole

 


or discharged upon completion of his or her maximum sentence and

 

who has the hepatitis C virus, the department shall comply with the

 

reporting of serious communicable diseases or infections

 

requirements established in rules promulgated under section 5111 of

 

the public health code, 1978 PA 368, MCL 333.5111.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No.1130                                    

 

          of the 97th Legislature is enacted into law.
