House Bill 5812 (as reported without amendment)

CONTENT

The bill would amend the Uniform Real Property Electronic Recording Act to require the Electronic Recording Commission to meet at least annually, rather than at least quarterly. The Act provides for the recording of electronic documents by a county register of deeds. It requires the Commission to adopt standards to implement the Act, keeping the standards in harmony with those of other jurisdictions that enact the uniform act.

FISCAL IMPACT

The bill could result in a minimal saving to the Department of Technology, Management, and Budget (DTMB) by reducing the number of Commission meetings in a year from four to one. The statute allows Commission members to be reimbursed for actual and necessary expenses incurred in the performance of their official duties as commissioners. The potential reduction in costs for these reimbursements is indeterminate and dependent on the actual amount of reimbursement commissioners request from the DTMB; however, these reimbursements should be minimal. According to the DTMB, no Commission members requested reimbursement for meetings held in 2013.
