CONTENT

 

The bill would amend the Michigan Liquor Control Code to authorize an on-premises licensee to allow the consumption of wine that was brought into the licensed premises in its original sealed container by a consumer who was not prohibited under the Code from possessing wine.  The wine would have to be produced by a wine maker, a small wine maker, or an out-of-State entity that was the substantial equivalent of a wine maker or small wine maker.  A licensee could charge a corkage fee for each bottle of wine brought by a consumer and opened on the premises by the licensee or the licensee's clerk, agent, or employee.

 

The licensee could not allow the consumer to remove a partially consumed bottle of wine that he or she brought into the premises unless the licensee or the licensee's clerk, agent, or employee capped the bottle or reinserted the cork so that the top of the cork was level with the lip of the bottle.
