AUCTIONEER REFERENCE IN NREPA H.B. 4684:
SUMMARY OF HOUSE-PASSED BILL
IN COMMITTEE
House Bill 4684 (as passed by the House)
Sponsor: Representative Cindy Denby
House Committee: Regulatory Reform
Senate Committee: Regulatory Reform
CONTENT
The bill would amend Part 821 (Snowmobiles) of the Natural Resources and Environmental Protection Act to delete a reference to an auctioneer as defined in Article 29 of the Occupational Code, and add a definition of "auctioneer".
Part 821 defines "dealer" as any person engaged in the sale, lease, or rental of snowmobiles as a regular business, other than an auctioneer as that term is defined in Article 29 of the Occupational Code. The bill would delete the reference to the defined term under Article 29.
The bill would define "auctioneer" as a person that is engaged in the business of conducting auctions or that offers to conduct an auction for compensation. "Auction" would mean the sale or offer for sale by bidding of real or personal property at a public or private location.
The bill is tie-barred to House Bill 4681, which would repeal Article 29 (Auctioneers) of the Occupational Code.
