CONTENT

 

The bill would amend Part 821 (Snowmobiles) of the Natural Resources and Environmental Protection Act to delete a reference to an auctioneer as defined in Article 29 of the Occupational Code, and add a definition of "auctioneer".

 

Part 821 defines "dealer" as any person engaged in the sale, lease, or rental of snowmobiles as a regular business, other than an auctioneer as that term is defined in Article 29 of the Occupational Code. The bill would delete the reference to the defined term under Article 29.

 

The bill would define "auctioneer" as a person that is engaged in the business of conducting auctions or that offers to conduct an auction for compensation. "Auction" would mean the sale or offer for sale by bidding of real or personal property at a public or private location.

 

The bill is tie-barred to Senate Bills 476 and 477 and to House Bill 4683. Senate Bill 476 would repeal Article 29 (Auctioneers) of the Occupational Code; Senate Bill 477 would repeal Section 28 of the State License Fee Act, which specifies various fees for registration as an auctioneer; and House Bill 4683 would amend the Michigan Liquor Control Code to delete a reference to registration requirements for auctioneers under Article 29 of the Occupational Code.
