CONTENT

 

The bill would amend the public employment relations Act to revise a provision under which collective bargaining between a public school employer and a representative of its employees may not include decisions about contracting with a third party for noninstructional support services, unless the bargaining unit providing the services is given an opportunity to bid on the contract on an equal basis as other bidders.

 

The Act identifies subjects that collective bargaining between a public school employer and a representative of its employees may not include. These subjects include the following:

 

 --    The decision of whether to contract with a third party for one or more instructional support services.

 --    The procedures for obtaining the contract for noninstructional support services, other than bidding described in this provision.

 --    The identity of the third party.

 --    The impact of the contract for noninstructional support services on individual employees.

 

This provision applies, however, only if the bargaining unit that is providing the noninstructional support services is given an opportunity to bid on the contract on an equal basis as other bidders.

 

Instead of that condition, the bill provides that if the public school employer decided to contract with a third party for noninstructional support services, the bargaining unit that was providing the services would have to be given an opportunity to bid on the contract.

 

Also, in the item that refers to the procedures for obtaining the contract for noninstructional support services, the bill would delete the exception for bidding described in this provision.
