CHILD WELFARE: COURT JURISDICTION S.B. 974:
SUMMARY AS ENACTED
Senate Bill 974 (as enacted) PUBLIC ACT 519 of 2014
Sponsor: Senator Bruce Caswell
Senate Committee: Families, Seniors and Human Services
House Committee: Appropriations
CONTENT
The bill amended the juvenile code to allow a court, until May 1, 2018, to issue an order affecting a party in a proceeding concerning a juvenile's care and supervision.
The juvenile code governs, among other things, the jurisdiction that courts have in proceedings pertaining to the disposition of juveniles. The bill specifies that in a proceeding under the code concerning a juvenile's care and supervision, the court may issue orders affecting a party as necessary. This provision will not apply after May 1, 2018.
For this purpose, the bill defines "party" as one of the following: a) the petitioner and juvenile in a delinquency proceeding, or b) in a child protective proceeding, the petitioner, child, respondent, parent, guardian, or legal custodian, the Department of Human Services (DHS), and any licensed child caring institution or child placing agency under contract with the DHS to provide for a juvenile's care and supervision.
The bill took effect on January 14, 2015.
