CONTENT

 

The bill would amend the juvenile code to allow the family court to issue an order affecting a party in a proceeding concerning a juvenile's care and supervision.

 

The juvenile code governs, among other things, the jurisdiction of the Family Division of Circuit Court (family court) in proceedings pertaining to the disposition of juveniles. The bill specifies that in a proceeding under the code concerning a juvenile's care and supervision, the court could issue orders affecting a party as necessary until May 1, 2018.

 

For this purpose, the bill would define "party" as one of the following: a) the petitioner and juvenile in a delinquency proceeding, or b) in a child protective proceeding, the petitioner, the Department of Human Services (DHS), child, respondent, parent, guardian, or legal custodian, and any licensed child caring institution or child placing agency under contract with the DHS to provide for a juvenile's care and supervision.
