CONTENT

 

The bill would amend the Support and Parenting Time Enforcement Act to allow the Friend of the Court to consider the person who was providing the actual care, support, and maintenance of a child as the recipient of the support. 

 

The Act provides that the Friend of the Court may, subject to notice requirements, consider the person who is legally responsible for the actual care, support, and maintenance of a child for whom support is ordered as the recipient of child support, and may redirect support paid for that child to the recipient.  The Act also requires the court to include within a child support order a statement that the Friend of the Court may do so, subject to certain provisions. 

 

The bill would refer in these provisions to the person "who is providing", rather than "legally responsible for", the actual care, support, and maintenance of a child.
