SUMMARY AS PASSED BY THE SENATE

CONTENT
Michigan Natural Resources Trust Fund. On December 5, 2012, the Michigan Natural Resources Trust Fund (MNRTF) Board adopted FY 2012-13 recommendations for acquisition and development projects pursuant to Article IX, Section 35 of the Michigan Constitution and the Natural Resources and Environmental Protection Act. The MNRTF Board revised its original recommendations on February 26, 2013, by reducing the amount for the Cranberry Lake Property acquisition project from $850,000 to $660,000. The recommendations, as revised, include a $23.3 million appropriation from the MNRTF for 22 acquisition projects and 54 development projects. Matching funds of $13,776,000 result in total project costs of $37,124,700. An appropriation bill is necessary to authorize the spending recommended by the MNRTF Board.
The attached information provides details on projects recommended, including a description of the project, location, and cost.
The bill would appropriate $23.3 million from the MNRTF for 22 acquisition projects and 54 development projects. Matching funds of $13,776,000 result in total project costs of $37,124,700.
The MNRTF consists of all bonuses, rentals, delayed rentals, and royalties collected or reserved by the State under provisions of leases for the extraction of nonrenewable resources from State-owned land, except such revenue accruing under leases of State-owned land acquired with money from the State or Federal Game and Fish Protection Fund or revenue accruing from land purchased with such revenue. Until the corpus of the MNRTF reached $500 million, annual expenditures consisted of MNRTF interest and earnings, and 33⅓% of MNRTF revenue received by the State during the previous fiscal year. The MNRTF reached $500 million in 2011, which limits future expenditures to annual interest and investment earnings. The Constitution provides that not less than 25% of the total amounts made available for expenditure from the Trust Fund from any State fiscal year must be spent for acquisition of land and rights in land and not more than 25% of the total amounts made available for expenditure from the Trust Fund from any State fiscal year must be spent for development of public recreation facilities.
Dredging. The bill also contains a total of $21.0 million for dredging activities at public recreational boating facilities. Funding for dredging would come from a combination of $9.5 million from the State Waterways Fund, and $11.5 million in General Fund/General Purpose revenue. The bill specifies 49 dredging projects; these projects mirror what was approved by the State Waterways Commission in a February 8, 2013, recommendation on emergency
dredging. A request for funding for dredging also was included in a fiscal year (FY) 2012-13 supplemental appropriation request from the State Budget Office that was submitted with the FY 2013-14 Governor's Recommendation for the Department of Natural Resources (DNR) budget on February 7, 2013.
Of the money that would be appropriated from the State Waterways Fund, $8.7 million is already allocated to several projects. The bill would reduce the appropriation authorization for those projects, and reallocate the revenue for emergency dredging. The Legislature would have to reappropriate funding for those projects in order for them to be continued in the future. The remaining State Waterways Fund dollars that the bill would appropriate would come from the available balance in the Fund.
Boilerplate
Sec. 301. Provides criteria for agreements with local units of government for administration of MNRTF grants.
Sec. 302. Provides for work project status of grants. Requires funds to be carried forward consistent with Section 248 of the Management and Budget Act.
(The Governor's budget recommendation eliminated line item appropriations for each project and instead included a roll-up appropriation of $23.5 million. The Governor included boilerplate that lists each project in line item format. The Senate maintained appropriation line items.)
Sec. 401. Specifies 14 current waterways projects totaling $8.7 million that would be reduced or eliminated in order to fund the emergency dredging projects.
Sec. 402. Requires the DNR to seek reimbursement from the U.S. Army Corps of Engineers for dredging costs related to harbors of refuge.
Sec. 403. Lists the 49 projects that would be required to be funded from the appropriations for emergency dredging. Also allows the DNR to fund other projects once the 49 listed projects are completed.
FISCAL IMPACT
The bill would appropriate $23.3 million from the MNRTF for 22 acquisition projects and 54 development projects. Matching funds of $13,776,000 result in total project costs of $37,124,700.
The bill also would appropriate $21.0 million for 49 emergency dredging projects for public boating access sites. Funding would come from a combination of $11.5 million in GF/GP revenue and $9.5 from the State Waterways Fund. Revenue from the State Waterways Fund would be redirected from currently authorized projects from the current and prior fiscal years.
