CONTENT

 

The bill as introduced was the appropriation bill for the fiscal year (FY) 2012-13 Michigan Natural Resources Trust Fund.  On December 5, 2012, the Michigan Natural Resources Trust Fund (MNRTF) Board adopted FY 2012-13 recommendations for acquisition and development projects pursuant to Article IX, Section 35 of the Michigan Constitution and the Natural Resources and Environmental Protection Act.  An appropriation bill is necessary to authorize the spending recommended by the MNRTF Board.

 

The Senate and House added funding for dredging harbors.  The House also added appropriations to continue review of Michigan's sentencing guidelines and practices, implementation of a veterans' service delivery initiative, and a new Marina Dredging Loan Origination Program.  The Senate concurred with the House changes.  Table 1 lists funding by budget area.

Boilerplate

 

State Spending/Payments to Locals.  Reporting section in compliance with Article IX, Section 30 of the Michigan Constitution of 1963.  (Sec. 201)

MNRTF Grant Criteria.  Provides criteria for agreements with local units of government for administration of MNRTF grants.  (Sec. 301)

 


Carry Forward Provision.  Provides for work project status of grants.  Requires funds to be carried forward consistent with Section 248 of the Management and Budget Act.  (Sec. 302)

 

Format Note:  The Governor's budget recommendation eliminated line item appropriations for each project and instead included a roll-up appropriation of $23.5 million.  The Governor included a language section that listed each project in boilerplate.  The Senate and House maintained appropriation line items.

 

Michigan Sentencing Guidelines Review. States that funds appropriated for the Legislative Council shall be used for a contract with the Council of State Governments to continue its review of Michigan's sentencing guidelines and practices, including, but not limited to, studying length of prison stay and parole board discretion.  (Sec. 351)

 

Waterways Projects. Specifies 14 current waterways projects, totaling $8.7 million, that would be reduced or eliminated in order to fund the emergency dredging projects. (Sec. 401)

Federal Reimbursement.  Requires the Department of Natural Resources (DNR) to seek reimbursement from the U.S. Army Corps of Engineers for costs related to the emergency dredging of harbors under the jurisdiction of the Corps of Engineers.  (Sec. 402)

Dredging Project List.  Lists 49 projects required to be funded from the appropriations for emergency dredging.  Also allows the DNR to fund other projects once the 49 listed projects are completed.  (Sec. 403)

Michigan Veterans Affairs Agency Strategic Plan.  Requires the Michigan veterans affairs agency shall submit a strategic plan to the Senate and House standing committees on appropriations, the Senate and House Fiscal Agencies, and the State Budget Office (SBO) by October 1, 2013.  (Sec. 501)

 

Michigan Veterans Affairs Agency Report. Requires the Michigan Veterans Affairs Agency shall submit a report to the Senate and House standing committees on appropriations, the Senate and House Fiscal Agencies, and the SBO by October 1, 2013, that includes a description of current programs, activities, roles and responsibilities of, and interrelationships among, State agencies, local government agencies, veterans service organizations and other nonprofit organizations to provide services and outreach to veterans, including providing assistance with the preparation and presentation of claims for benefits to the United States Department of Veterans Affairs.  A description of the activities, roles and responsibilities of, and interrelationships among, State agencies, local government agencies, veterans service organizations, and other nonprofit organizations undertaken under the re-engineered veterans service delivery system identified in the strategic plan developed pursuant to section 401.  (Sec. 502)

 

Michigan Veterans Affairs Agency Quarterly Reports.  Requires the Michigan Veterans Affairs Agency shall submit quarterly reports providing a summary of the Agency's activities, including data on the number of claims presented to the United States Department of Veterans Affairs by the Agency.  (Sec. 503)

 

Marina Dredging Loan Origination Program Work Project Designation.  Designates the marina dredging loan origination program as a work project.  (Sec. 601)

 

FISCAL IMPACT

 

Michigan Natural Resources Trust Fund.  The funding, as recommended by the MNRTF Board on December 5, 2012, and revised on February 26, 2013, includes a $23.3 million appropriation from the MNRTF for 22 acquisition projects and 54 development projects.  Matching funds of $13,776,000 result in total project costs of $37,124,700.  Tables 2 and 3 provide details on projects recommended, including a description of the project, location, and cost.

 

Department of Natural Resources Dredging.  The bill also contains a total of $21.0 million for dredging activities at public recreational boating facilities.  Funding for dredging would come from a combination of $9.5 million from the State Waterways Fund, and $11.5 million in General Fund/General Purpose revenue.  The bill specifies 49 dredging projects; these projects mirror what was approved by the State Waterways Commission in a February 8, 2013, recommendation on emergency dredging.  A request for funding for dredging also was included in a FY 2012-13 supplemental appropriation request from the SBO that was submitted with the FY 2013-14 Governor's Recommendation for the DNR budget on February 7, 2013.

Of the money that would be appropriated from the State Waterways Fund, $8.7 million is already allocated to several projects.  The bill would reduce the appropriation authorization for those projects, and reallocate the revenue for emergency dredging.  The Legislature would have to reappropriate funding for those projects in order for them to be continued in the future.  The remaining State Waterways Fund dollars that the bill would appropriate would come from the available balance in the Fund.

Michigan Sentencing Guidelines Study.  The bill transfers $250,000 from the Department of Corrections Budget to the Legislative Council for a contract with the Council of State Governments to continue its review of Michigan's sentencing guidelines and practices, including, but not limited to, studying length of prison stay and parole board discretion.  The fund transfer is included in SBO request 2013-7.

 

Veterans' Service Delivery Initiative.  The House included 11.0 FTEs and $2,997,500 GF/GP for the Department of Military and Veterans Affairs to commence implementation of a veterans' service delivery initiative as provided for in Executive Order 2013-2.  The Executive Order created the Michigan Veterans Affairs Agency.  The supplemental funding is consistent with SBO request 2013-4.

 

Marina Dredging Loan Origination Program.  The bill reduces the Qualified Agricultural Loan Program by $1.0 million GF/GP, from $15.0 million to $14.0 million.  The Department of Treasury estimates that demand for the Qualified Agricultural Loan Program will be substantially below the current $15.0 million appropriation.  Applications for payments under the program, however, can be submitted until March 31, 2013.  The $1.0 million is transferred to a new Marina Dredging Loan Origination Program to provide financial assistance to eligible marinas to alleviate financial distress caused by low water levels affecting watercraft use and related economic impacts.  The program will support payments to qualified financial institutions for marina dredging loan origination fees for administrative costs incurred by qualified financial institutions.  Senate Bill 252 would create a marina dredging loan origination program to pay a limited amount of loan origination fees to financial institutions that issue loans for marina dredging to eligible applicants on specific terms.
