A SUMMARY OF HOUSE BILL 5748 AS REPORTED BY COMMITTEE 10-2-14

The bill would amend Section 2 of Public Act 372 of 1927 (MCL 28.422), an act that regulates the possession and carrying of concealed pistols.  The bill would make a technical correction by eliminating a reference to a definition that had been contained in Section 231a of the Michigan Penal Code but was removed by Public Act 427 of 2012.

Under Section 231a of the Michigan Penal Code, owners of a licensed pistol who do not have a CPL are restricted to transporting that pistol in a vehicle only for a lawful purpose and only if contained in the manner prescribed by law.  Public Act 427 of 2012 (enrolled House Bill 5282) deleted the definition of the term "lawful purpose" that had been contained in Section 231a; that definition is still referenced in Section 2 of PA 372.

The bill makes a technical correction to statute.
