A SUMMARY OF HOUSE BILL 5048 AS INTRODUCED 10-2-13
The bill would allow public access to records of the proceedings of certain veterans treatment court programs if a judgment of guilt is entered.
Currently, all records of proceedings regarding the participation of an individual in a veterans treatment court pertaining to a discharge and dismissal are closed to public inspection and exempt from public disclosure under the Freedom of Information Act.
House Bill 5049 would amend the Revised Judicature Act to instead allow access to all records regarding an individual's participation in the veterans treatment court program if the court entered a judgment of guilt. Otherwise, the current requirement for the Department of State Police to maintain a nonpublic record of the discharge and dismissal proceedings, accessible only as specified in statute, remains in force.

There would be no material fiscal impact on the Department of State Police for House Bill 5049.
