     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding section 20174.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 20174. (1) An employee of a health facility or agency is

 

exempt from immunization otherwise mandated by the health facility

 

agency without recourse or termination of employment, if the

 

employee states in writing that he or she refuses immunizations due

 

to religious convictions or other conscientious objection to the

 

mandated immunization.

 

     (2) This section does not apply during the period of time when

 

the world health organization designates an outbreak of a disease

 

as a "phase 6 outbreak" for that specific disease and the health

 

facility or agency is trying to control or respond to that

 


outbreak. During the time described in this subsection only, a

 

health facility or agency may require an employee to receive an

 

immunization for the specific disease that is the subject of the

 

world health organization's phase 6 outbreak designation.
