SENATE BILL No. 699

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

by amending section 874 (MCL 600.874).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 874. (1) The probate court shall charge and collect the

 

following fees:

 

     (a) For performing a marriage ceremony, $10.00.

 

     (a) (b) For issuance of a commission to take testimony, $7.00.

 

     (b) (c) For taking, certifying, sealing, and forwarding

 

depositions, $5.00, and 10 cents per folio page, which fees shall

 

be considered as costs in the case; and for each copy of the

 

deposition furnished, 3 cents per folio page.

 


     (2) The state court administrative office shall determine the

 

fee for a probate judge to perform a marriage ceremony. Except as

 

provided in this subsection, a probate judge shall charge that fee

 

to perform a marriage ceremony. A probate judge may waive the fee

 

for performing a marriage ceremony if the parties thereto to the

 

marriage are indigent.

 

     (3) A fee paid under subsection (2) shall be remitted to the

 

probate court for the county in which the probate judge performing

 

the marriage serves.

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No. 698                                        

 

          of the 96th Legislature is enacted into law.
