A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 20174.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 20174. (1) As used in this section:
(a) "Practice of surgical technology" means working
collaboratively with perioperative nurses on surgical patient care
that includes, but is not limited to, the following tasks or
functions:
(i) Preparing the operating room for surgical procedures by
ensuring that surgical equipment is functioning properly and
safely.
(ii) Preparing the operating room and the sterile field for
surgical procedures by preparing sterile supplies, instruments, and
equipment using sterile techniques.
(iii) Anticipating the needs of the surgical team based on
knowledge of human anatomy and pathophysiology and how they relate
to the surgical patient and the surgical procedure being performed
on that patient.
(iv) As directed in an operating room setting, performing tasks
within the sterile field including any of the following:
(A) Maintaining asepsis and correcting breaks in the sterile
field.
(B) Passing supplies, equipment, or instruments according to
the needs of the surgical team.
(C) Sponging or suctioning an operative site.
(D) Preparing and cutting suture materials.
(E) Transferring and irrigating with fluids.
(F) Transferring but not administering drugs.
(G) Handling specimens.
(H) Holding retractors and other instruments.
(I) Applying electrocautery to clamps on bleeders.
(J) Connecting drains to suction apparatus.
(K) Applying dressings to closed wounds.
(L) Counting sponges, needles, supplies, and instruments with
the registered professional nurse who is performing circulator
nurse duties.
(b) "Surgical facility" means a hospital, freestanding
surgical outpatient facility, or other similar entity that utilizes
surgical technologists.
(c) "Surgical technologist" means an individual who engages in
the practice of surgical technology.
(2) A surgical technologist shall complete 15 hours of
continuing education during each calendar year. A surgical
technologist who holds and maintains the national certification
established by the national board of surgical technology and
surgical assisting for the surgical technologist is considered to
have met the continuing education requirements of this subsection.
A surgical facility that employs, contracts with, or grants
clinical privileges to a surgical technologist shall maintain
documentation that the surgical technologist meets the continuing
education or certification requirements of this subsection.
(3) A surgical facility that seeks to employ, contract with,
or grant clinical privileges to a surgical technologist shall at a
minimum post its surgical technologist job openings on the Michigan
talent bank, the department of community health internet website,
or a similar job opening internet website operated by this state.
(4) This section does not prohibit a health professional who
is licensed, registered, or otherwise authorized to engage in a
health profession under article 15 from performing tasks and
functions within the practice of surgical technology if the
individual is acting within the scope of his or her license,
registration, or authorization.
Enacting section 1. This amendatory act takes effect January
1, 2013.
