A bill to limit the compensation for certain positions in
public employment; and to limit compensation for certain contracts
to provide services to public bodies.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. (1) This act shall be known and may be cited as the
"publicly funded positions compensation limitation act".
(2) The following positions that are paid from state or local
government funds shall be limited to compensation that is no more
than the amount established for the governor by the state officers
compensation commission under section 12 of article IV of the state
constitution of 1963:
(a) An appointed position in the executive branch of state
government that is not a part of the classified service.
(b) A position in the government of a city, village, township,
county, or other political subdivision of this state; a public
school district; an intermediate school district; a special
district; a board, agency, commission, or authority; or any other
local public entity of this state, if the position is filled by
appointment of the governor or the governor's designee and the
compensation for the position is not established under a merit
system for the employees for the unit of government as provided in
section 6 of article XI of the state constitution of 1963.
(c) A position awarded by a discretionary appointment by the
governor or the governor's designee or through a contract awarded
by an entity in the executive branch of state government that is
obtained through a process other than competitive bidding to
provide personal services to this state; a political subdivision of
this state; a city, village, township, or county; a public school
district; an intermediate school district; a special district; a
board, agency, commission, or authority; or any other public entity
of this state.
(3) The limitation on compensation in subsection (2) does not
apply to any of the following:
(a) An individual holding an elected position in state or
local government.
(b) A position in or under contract to the legislative or
judicial branch of state government.
(c) A position under a contract in effect on the effective
date of this act until the contract is terminated, extended, or
renewed.
(d) A position in or under contract to a public university or
other public institution of higher education.
