A bill to amend 1976 PA 442, entitled
"Freedom of information act,"
(MCL 15.231 to 15.246) by adding section 14a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 14a. (1) A person shall not destroy or conceal a document
that is the subject of a pending request for disclosure under this
act with the intent to prevent the disclosure of that document.
(2) A person that violates this section is guilty of a crime
as follows:
(a) For a first offense, a misdemeanor punishable by
imprisonment for not more than 2 years or a fine of not more than
$2,000.00, or both.
(b) For a second or subsequent offense, a felony punishable by
imprisonment for not more than 5 years or a fine of not more than
$5,000.00, or both.
