A bill to amend 1927 PA 175, entitled
"The code of criminal procedure,"
(MCL 760.1 to 777.69) by adding section 10 to chapter V.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
CHAPTER V
Sec. 10. (1) Notwithstanding any other provision of this
chapter, a court shall allow a charitable bail organization to
become a surety or post bail for the appearance of a person charged
with a felony, a misdemeanor, or an ordinance violation.
(2) A charitable bail organization shall not receive
compensation for becoming surety or posting bail under this
section.
(3) As used in this section, "charitable bail organization"
means a person exempt from taxation under section 501(c)(3) of the
internal revenue code of 1986, 26 USC 501, registered under the
charitable organizations and solicitations act, 1975 PA 169, MCL
400.271 to 400.294, and organized for the purpose of posting cash
bail on behalf of poor individuals.
