HOUSE BILL No. 5394

     A bill to create the domestic reimbursement utilization grant

 

fund; to provide for distribution of money from the fund; and to

 

prescribe the powers and duties of certain state agencies and

 

officials.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) This act shall be known and may be cited as the

 

"domestic reimbursement utilization grant fund act".

 

     (2) The domestic reimbursement utilization grant (DRUG) fund

 

is created within the state treasury.

 

     (3) The state treasurer may receive money or other assets from

 

any source for deposit into the fund. The state treasurer shall

 

direct the investment of the fund. The state treasurer shall credit

 

to the fund interest and earnings from fund investments.

 

     (3) Money in the fund at the close of the fiscal year shall


 

remain in the fund and shall not lapse to the general fund.

 

     (4) The department of environmental quality shall be the

 

administrator of the fund for auditing purposes.

 

     (5) The department of environmental quality shall expend money

 

from the fund, upon appropriation, only to provide grants to

 

private property owners for use in cleaning up environmental

 

contamination of that property caused by the illegal manufacture of

 

methamphetamine. A grant under this subsection is subject to the

 

following:

 

     (a) Not more than 1 grant shall be awarded to any property

 

owner or group of property owners in a single year for purposes of

 

cleaning up environmental contamination on a single property.

 

     (b) The total grant amount shall not exceed $5,000.00.

 

     (c) A grant shall not be awarded if the property owner or

 

group of property owners participated in the violation or, having

 

knowledge that the violation was occurring or was about to occur on

 

that property, failed to promptly report the violation or possible

 

violation to a police agency.

 

     (d) A grant under this subsection shall be awarded secondary

 

to any other reimbursement received or to be received by the

 

property owner or group of property owners, including reimbursement

 

by another governmental entity or an insurance provider.

 

     Enacting section 1. This act takes effect October 1, 2012.

 

     Enacting section 2. This act does not take effect unless all

 

of the following bills of the 96th Legislature are enacted into

 

law:
