A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 57v.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 57v. (1) Not later than 60 days after the effective date
of the amendatory act that added this section, the department shall
establish a program of substance abuse testing as a condition of
eligibility for family independence program assistance benefits
under this act. The department shall require applicants for family
independence program assistance benefits to submit to substance
abuse testing before a final determination of eligibility.
(2) If an applicant tests positive for substance abuse, the
applicant is ineligible to receive family independence program
assistance benefits under this act.
(3) If an applicant refuses to submit to substance abuse
testing, the applicant is ineligible to receive family independence
program assistance benefits under this act.
(4) If an applicant tests negative for substance abuse and
meets all the other eligibility requirements for family
independence program assistance benefits, the cost of administering
the substance abuse test to the applicant shall be deducted from
his or her first family independence assistance payment.
