A bill to require public employers to submit information
concerning highly compensated public employees and severance
packages for public employees to the state; to require electronic
posting of compensation information; and to require duties of
certain state departments and agencies.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the
"public employee compensation disclosure act".
Sec. 2. As used in this act:
(a) "Department" means the department of technology,
management, and budget.
(b) "Public employee" means an individual who is employed by
this state; a department or agency of this state; a city, village,
township, county, or other political subdivision of this state; a
school district, intermediate school district, or special district;
a community college or junior college as described in section 7 of
article VIII of the state constitution of 1963; an institution of
higher education, as described in section 4 of article VIII of the
state constitution of 1963; or any other public entity of this
state or of a political subdivision of this state.
(c) "Severance payment" means a payment that is additional
compensation paid or payable by the public employer if a public
employee's employment terminates. Severance payment does not
include a payment under a retirement plan that is generally
applicable to employees of the public employer.
Sec. 3. By June 1 of each year, a public employer shall
provide the department with all of the following information:
(a) The compensation of each of its employees to whom the
public employer provides wages and benefits with an aggregate
annual cost that exceeds $100,000.00.
(b) The terms of each severance payment agreement entered into
since the last reporting period.
Sec. 4. A report under this act shall be submitted
electronically in a format specified by the department. The
department shall post the information on a website that is
accessible to the public within 90 days after receiving the
information.
