A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 61505b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 61505b. Notwithstanding any other provision of this part,
until the advisory committee makes its recommendations to the
department and the department of natural resources related to the
extraction of natural gas from shale formations in this state,
pursuant to section 61529, the department shall not issue a permit
under this part that allows hydraulic fracturing in either of the
following circumstances:
(a) From horizontal wells.
(b) From wells located within Utica or Collingwood shale.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 5151(request no.
02574'11 *) of the 96th Legislature is enacted into law.
