A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 10d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 10d. (1) For a new applicant applying for benefits,
service, or assistance through the department, the department shall
use e-verify to ascertain the legal residency status of that
applicant before making any benefit, service, or assistance
available to the applicant.
(2) Beginning on the effective date of the amendatory act that
added this section, for a current recipient of benefits, service,
or assistance through the department, upon the department's next
eligibility review of that recipient, the department shall use e-
verify to ascertain the legal residency status of that recipient or
known member of the recipient's household before renewing
eligibility for any benefit, service, or assistance received by the
recipient.
(3) If the department cannot confirm a recipient's,
applicant's, or known member of a recipient's household address
using e-verify, the department shall not provide the benefit,
service, or assistance to the recipient or applicant.
(4) Notwithstanding any other provision of this act, and
according to sections 10b and 10c, the department shall disclose
the address of a recipient, applicant, or known member of a
recipient's or applicant's household to a federal, state, or local
law enforcement officer if e-verify renders a negative confirmation
of legal residency status.
(5) If at any time the department receives information
indicating identity fraud as the basis of positive confirmation of
legal status on the part of a recipient, applicant, or known member
of a recipient's or applicant's household, all benefits, services,
and assistance shall immediately be terminated, and a federal,
state, or local law enforcement officer shall be notified
immediately.
(6) As used in this section, "e-verify" means the United
States department of homeland security's internet-based system that
allows an employer to determine the eligibility of an employee to
work in the United States.
