A bill to require public bodies to provide certain information
to a municipality before installing a video surveillance camera in
the municipality; and to provide for the powers and duties of
certain state and local governmental officers and entities.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the
"public body video surveillance camera disclosure act".
Sec. 2. As used in this act:
(a) "Electronic information" means audio, video, or any other
information recorded, collected, or otherwise obtained by a video
surveillance camera.
(b) "Municipality" means a county, city, village, or township
of this state.
(c) "Public body" means any of the following:
(i) A state officer, employee, agency, department, division,
bureau, board, commission, council, authority, or other body in the
executive branch of the state government.
(ii) An agency, board, commission, or council in the
legislative branch of the state government.
(iii) An agency, board, commission, or council in the judicial
branch of state government.
(iv) A county, city, township, village, intercounty, intercity,
or regional governing body, council, school district, special
district, or municipal corporation or a board, department,
commission, council, or agency thereof.
(v) Any other body that is created by state or local authority
or that is primarily funded by or through state or local authority.
(vi) The federal government or any agency or instrumentality of
the federal government.
Sec. 3. (1) Before a public body installs a video surveillance
camera in a municipality, the public body shall provide written
notice to the elected officials of the municipality specifying all
of the following:
(a) The location within the municipality where the video
surveillance camera will be installed.
(b) The public body's purpose for installing the video
surveillance camera.
(c) The specifications of the video surveillance camera.
(d) The public body's intended use of the electronic
information.
(e) The location where the electronic information is sent or
stored, or both.
(2) A public body that installs or maintains a video
surveillance camera within a municipality shall make the location
where the electronic information is sent or stored, or both,
available for inspection by the elected officials of the
municipality.
