A bill to amend 1984 PA 431, entitled
"The management and budget act,"
by amending sections 353 and 358 (MCL 18.1353 and 18.1358),
section 353 as amended by 1999 PA 8 and section 358 as amended by
2002 PA 504.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 353. (1) In a calendar quarter following a calendar
2 quarter in which the seasonally adjusted state unemployment rate
3 as certified by the director of the department of career
4 development or its successor is 8% or more, an amount may be
5 appropriated from the fund by the legislature for the purposes
6 listed in this section in accordance with the following table:

14 (2) The legislature may appropriate by law money from the
15 fund in the amounts as provided in this section to assist in the
16 following countercyclical economic stabilization purposes:
17 (a) Capital outlay.
18 (b) Public works and public service jobs.
19 (c) Refundable investment or employment tax credits against
20 state business taxes for new outlays and hiring in this state.
21 (d) Any other purpose the legislature may provide for in an
22
appropriation bill as provided by law. which
provides employment
23 opportunities counter to the state's economic cycle.
24 (3) Notwithstanding subsections (1) and (2), there is hereby
25 appropriated $40,000,000.00 from the fund for the Michigan state
26 parks endowment fund. The appropriation provided for in this
27 subsection shall only be effective after the proceeds from the
28 sale of the accident fund have been transferred to the fund as
1 provided for in section 701a of the worker's disability
2 compensation act of 1969, 1969 PA 317, MCL 418.701a.
3 Sec. 358. (1) Except as otherwise provided in this section,
4 the legislature may make an emergency appropriation from the fund
5 subject to all of the following conditions:
6 (a) The maximum appropriation from the fund for budget
7 stabilization as provided in section 352(2) has already been made
8 for the current fiscal year.
9 (b) The legislature has approved the emergency
10 appropriations bill by a 2/3 majority vote of the members elected
11 to and serving in each house.
12 (c) The emergency appropriations bill becomes law.
13 (2) The additional transfer from the fund may be made only
14 for the current fiscal year.
15 (3) For the fiscal year ending September 30, 2001, the
16 fiscal year ending September 30, 2002 and for each fiscal year
17 beginning with the fiscal year ending September 30, 2004 and
18 ending with the fiscal year ending September 30, 2016, there is
19 appropriated and transferred from the fund to the state trunk
20 line fund established under section 11 of 1951 PA 51, MCL
21 247.661, the sum of $35,000,000.00.
22 (4) For the fiscal year ending September 30, 2000, there is
23 appropriated and transferred from the fund to the state trunk
24 line fund established under section 11 of 1951 PA 51, MCL
25 247.661, the sum of $37,100,000.00.
26 (5) For the fiscal year ending September 30, 2000, an amount
27 equal to the unreserved general fund/general purpose balance
1 transferred to the fund for the fiscal year ending September 30,
2 2000, but not to exceed $62,900,000.00, is appropriated and
3 transferred from the fund to the state trunk line fund
4 established under section 11 of 1951 PA 51, MCL 247.661.
5 (6) For fiscal year ending September 30, 2012, there is
6 appropriated and transferred from the fund, $650,000.00 to local
7 units of government to reimburse the costs of conducting a
8 special election to fill a vacancy in the office of
9 representative in congress as determined by the department.
